However in section 3 A person who assaults another causing him or her harm shall be guilty of an offence . Section 4 then states a person or intentionally …show more content…
In R v Flynn 1867 the incident was for manslaughter and the prisoner was charged with having killed John Tracey . From the evidence shown , a fight took place between a prisoner and his friends on one side and the deceased and his friends on the other . Both were throwing stones and sticks at each other .After the fight the prisoner threw a stone at the deceased which struck him on the forehead over the right eye and knocked him down . The deceased then got up and went into the public house . He went to bed and the next day was feeling a bit weak and tired. Two days following this he past away. There was insufficient evidence for the jury to establish the death of the deceased was caused by the throwing of the stone. The doctor says in terms that the blow was the cause of death Except there was nothing in the evidence to cause injury except the blow . The doctor says the injury could have been caused by a fall but there was no evidence of a fall except what was caused by the blow The doctor says that by a short chain of causation , the blow caused the fracture and the fracture caused the death. It can be argued that there was a chain of causation in Murt and Bernies situation.Bernie colliding with Murt caused the pain in Murt's tooth which lead to it having to be removed
Further, possession is consistent with the facts of that burglary. The evidence in Detective Ta’ala’s and Dr Foster’s formal statements which correlate to prove James was attacked with a weapon on May 4. Detective Ta’ala describes a police call, blood trail and description of injuries consistent with an attack and largely consistent with Dr Foster’s description of James’ injury as “3cm vertical ragged laceration”, an injury that could be caused by a screwdriver-like weapon.
1. Give an example of a mala prohibita crime and describe why it is mala prohibita. An example of a mala prohibita crime would be driving over the speed limit. When people do this they are breaking the law, but they are not doing it in a malicious way; they are not trying to be bad.
correctly, the accused will always be held responsible for any injury caused by an unknown condition, or in this case, belief. Robert Blaue was to be sentenced for counts one and two against him, which would be manslaughter on the ground of diminished responsibility (Court) and wounding with the intent to do grievous bodily harm (ROBERT). He was also sentenced separately for the third, fourth, and fifth counts he had also accumulated. These counts included one count of indecent assault against Regina, and two additional counts of indecent assault from two other unrelated accounts (ROBERT). On July 9th, 1975, Robert Konrad Blaue was officially convicted and sentenced (ROBERT).
Criminal behaviour has always been an interest for psychologists, for they could never quite come to a conclusion between nature and nurture. Research concerning this topic has been organized for many years and due to the never ending debate, is still being conducted. I have decided to read and write about this myself, for I was genuinely curious about the matter and wanted to be a part of the research, as I felt responsible to do so. I believe that in order to stop something, it must be discussed and scrutinized. What effects do genes have on criminal behaviour, why do peer pressure and habitat influence a person to commit crimes and are men really more violent than women?
The traditional goals of sentencing are retribution, deterrence, incapacitation and rehabilitation (Stinchcomb, 2011). A more contemporary goal of criminal sanctions is restorative and community justice (Stinchcomb, 2011). Retribution is founded on the principle that offenders should receive their ‘just desserts’. However, the penalty must be proportionate to the offence committed (Welch, 2004, p.83) Deterrence aims to reduce criminal offending.

In the novel To Kill a Mockingbird by Harper Lee the term mockingbird symbolizes innocence in a person. In the novel it focuses on the fact that innocence, represented by the mockingbird, can be wrongfully harmed. There are two characters: Tom Robinson and Arthur “Boo” Radley that are supposed to represent the mockingbird. In the novel, Tom Robinson is the best example of a mockingbird because he is prosecuted for a crime he did not commit. Also, he was judged unfairly based on the color of his skin in his trial.
Students in the criminal justice department are taught that our main objective in the justice system and our careers is to serve and also protect those involved in our community. For as long as I can remember, my goal in life has been to provide service by protecting and serving those who are close to me. My penchant for service is what eventually led me to the Criminal Justice program at Valdosta State University. This passion for service began at a very young age when my life was turned upside down when I relocated from Puerto Rico to the state of Georgia due to a tragic car accident that led to the end of my father’s life. This sudden change of lifestyle and heartbreak came with an extreme amount of struggle and culture shock not just
Your parents are always telling you to do do the right thing, aren't they? Priscilla Cummings did not miss the opportunity to convey the same message. In The Red Kayak, Priscilla Cummings is trying to show that doing the right thing, no matter the consequences is always the correct path to take. In this paper, I will give a few examples of why I think the theme in the story is to always do the right thing. These examples are that Brady had the choice to call out to the kayak, the scene with Digger and J.T. in court, and I will show you this in a more philosophical way.

The victim is engaged in official duty such as a firefighter, police officer, teacher, health care practitioner and the like. Even if no injury is committed, just the mere threatening of an individual with a dangerous weapon can get you an allegation of aggravated assault. It is also often charged to people committing felony such as burglary and robbery, even if there is no real apparent danger. If charged of aggravated assault and proven guilty, you could be facing five years, seven and a half years, up to fifteen years imprisonment depending on the level of aggravated assault.
Is your first instinct to say one with a criminal conviction should never be a teacher? Why or Why Not? Discuss. I personally feel a person who holds a criminal background should be able to be a teacher under the following conditions: criminal conviction was due to a minor infraction, the quantity of convictions is minimal, and the conviction did not occur recently. Minor infractions can included the following: drug possession, petty theft, and driving under the influence (DUI).
The judge declares the “Murder in the first degree—premeditated homicide—is the most serious charge tried in our criminal courts. One man is dead. The life of another is at stake. If there is a reasonable doubt in your minds as to the guilt of the accused … then you must declare him not guilty. If, however, there is no reasonable doubt, then he must be found guilty.
There are three components that make up the criminal justice system – the police, courts, and correctional facilities – they all work together in order to protect individuals and their rights as a citizen of society to live without the fear of becoming the victim of a crime. Crime, simply put is when a person violates criminal law; the criminal justice system is society’s way of implementing social control. When all three components of the criminal justice work together, it functions almost perfectly. For a person to enter the criminal justice system, the process must begin with the law enforcement.
Every day on the news there are all kinds of reports. Crime reports are a major part of today's events. Almost every day there are posts about crimes. The level of crime has risen immensely in every corner of the world. People have tried to understand the causes of crime, but if we look around the world we can see that many of the crimes are caused by people who abuse drugs and alcohol, people who think negatively towards others, and poverty.
