The complainant, Mr. Shawn Thomas, known to the Department under NYSID# 05036218Z, who resides at 130 Pelham Road New Rochelle NY 10805, was interviewed by investigators. Mr. Thomas stated that he had $150.00 inside of his camera bag. The last time he saw his camera bag was when he was inside of his cell and saw the subject officer, PO Miroshnyk, searching it on the desk. He did not see the officer remove any money while he was searching his bag. He received $5000.00 in cash as a donation from Deborah Goodman. He never deposited that money into a bank and did not have a receipt for the currency. He left his apartment at approximately 1700 hours on July 8, 2015 and went to Manhattan. He stated there were three (3) officers at the scene, "Sergeant Eill", in plain clothes, an "Offi cer Picks", in uniform, and the "arresting officer". He stated that when he was arrested he had his camera bag which was has a shoulder strap, and was secured around his waist. Inside of the bag, was a camera, audio recording equipment, and $150 in cash (3 $50 bills). Upon his arrest he was searched briefly at the scene, and placed in a "marked car" and transported to TD30 station house. The officers did not search his bag at the scene. Once at the TD30 station house the officers searched him in front of the desk where PO Miroshynk removed his camera bag from his waist, counted the $3.68, which was in his pants pocket. PO Miroshnyk placed his camera bag on the desk where the sergeant sits, and did not search the bag there. He was then taken to the cell are and PO Miroshnyk started going through his bag. He stated that he realized his $150 was missing when he observed the officer take out his camera but not the money out of his bag. The complaint states that on October 14, 2016, plaintiff Kirk Thompson, a UPS driver, delivered a box to defendant Eleanor Lewis at her single-family home in White Plains, New York. When Mr. Thompson placed the box on the front stoop and rang the doorbell, he heard Ms. Lewis’s dog barking and scratching the other side of the door. Mr. Thompson then walked back to his van when he heard a female voice behind him instructing him not to move. As Mr. Thompson turned around, Ms. Lewis’s dog, Simon, bit him on the arm, requiring surgery for Mr. Thompson and him missing six months of work due to his inability to drive.

10 Investigative Skills (7PA0006337) - Officer Stark responded to a PC211-Robbery radio call at 1038 E. Colorado Blvd. The comments of the call stated 2 Female Asians and 2 Male Asians pushed the Victim out of his wheelchair and took his wallet containing $25. Stark responded to the location, even though it was out of his beat, and asked me if he could handle the call. I advised the beat Officer that we would handle the incident for training. As we entered the Rite Aid, the Victim was sitting in his wheelchair directly in front of the exit.

Oetzel willingly provided the key to the safe and authorized me to open and check it. Auxiliary Officer Runge opened the safe and discovered a plastic container containing 10 syringes. Furthermore, the safe also contained a grinder with trace amounts of a green, leafy substance. I asked Oetzel if he was a diabetic, he stated that he was not. I then read Oetzel his Miranda rights by my agency issued card.
On 04/23/16 I contacted Andrew Jepko at Pinching Pennies in reference to a theft of property call. Mr. Jepko said on this date at around 1230 hours a white male, white female and mixed juvenile male entered the store and browsed around for a while. Mr. Jepko said the party exited the store and the group stood outside the business for a short period and then the female reentered, expressing interest in a set of tires he was selling; which were stacked in front of the business. First complaint report (DOI 5/26/2014 at 162 Troy Avenue) for criminal contempt: CV Yvone Jameson filed a complaint for criminal contempt against P. CV Jameson states that P punched her in the face and head while she was holding her 3 month old daughter. CV Jameson has a valid order of protection from criminal court against P which expires on 10/10/2018. Second complaint report (DOI 6/3/2014 at 162 Troy Avenue, Apt. 14J) for assault: CV Reginaldo Taylor states that P did punch him on the left side of the face causing pain.

Supplemental Narrative: On 09/24/15 at approximately 1350 hours, I, Officer Artaz along with Officer Reece responded to 311 Dodge Street apartment 7 to assist Deputy Sparks and Deputy Buffington with executing a felony warrant. The wanted person was identified as Gerald McNeil (DOB 03/26/82). Upon arrival, Officer Reece and I escorted Deputy Sparks to Gerald's apartment. Deputy Sparks knocked on the door and a short time later Gerald answered the door. Deputy Sparks asked Gerald to step out into the hallway, so they could talk.

On April 6, 2016, Tamar Christopher Sweat appeared before the Honorable Judge Joel P. Crowe of the Portsmouth Juvenile and Domestic Relations Court for charges of underage possession of a firearm, reckless handling of a firearm and possession of stolen property. Tamar was accompanied by his legal guardian and grandmother, Gail Sweat. Assistant Commonwealth’s Attorney Kara Cooper prosecuted the case, and Tamar was represented by Deputy Public Defender Bernadine Gerlach. A plea agreement between the prosecution and defense was submitted, and the court accepted the agreement.
