Many schools are faced with the dilemma of having to update their code of conduct but what is the need for the codes of conduct to be updated. In prior off campus incidents the school could not do anything about them, but why? Those incidents were on cyberbullying or online.harassment which meant it was happening online on the internet and not on the school’s campuses. Since the code of conduct is limited to what happens on school ground the school could not do anything. This led to the school district’s stance of claiming the schools were unable to do anything due to not having jurisdiction on cyberbullying cases since the incidents did not happen on the school campuses. If the school does not act on the situation that is affecting their students then it may interfere with the students learning and learning environment and that can lead to psychological, mental, and physical stress. If that is the case and it usually is then the school is held accountable for not taking any action on the situation. However when this happened in the past school districts played the same card every time this type of situation occurred and said that their hands were tied on the situation because it was not happening on school grounds. So cyberbullying was swept under the carpet and nothing was ever done to deal with cyberbullying happening. It was not very long until the school could no longer get away with doing nothing about online harassment and cyberbullying cases. The incidents were going unnoticed without any action or consequences for them but that all started to change once schools were being sued. Schools were being sued on the premises that never had involvement to stop and discipline the cyberbullying that was happening. Digital pile on is an example of one of those instances where multiple people can be involved anywhere from it being two people involved to as many as a whole classroom or even the whole school. Regardless of how many people are involved the school needs to be able to make sure the ones who are part of digital pile on are given the correct punishment. This is where it gets tricky, since multiple people were involved every individual said something different from each other, so every person involved would not all get the same punishment. If the school fails to implement this part for digital pile into the code of conducts some students may receive a lighter punishment when the student actually should receive a harsh punishment. Another flaw that could occur is if a student is part of digital pile and only contributed an emoji to the pile and is given the same punishment as someone who deserves a harsh punishment then the school could be sued for unnecessary punishment which is why schools need to create a code of conduct with different levels of punishment for different types of
