List the courtroom actors and their function in the courtroom.
The principle actors in the courtroom are the lawyers, law enforcement, a U.S. attorney, a court support staff, and other courtroom participants. The judge presides over the courtroom and is responsible for maintaining order, providing the jury with guidance in the interpretation of laws, issues warrants, sets bail, rules on pre-trial motions and is determines sentences within guidelines. The prosecution represents the state/the victims in criminal trials. A prosecutor’s responsibilities are to be professional, seek justice, and strive for the truth. Prosecutors live up to their responsibilities by gathering evidence, collecting witness testimonies, and obtaining other information to present a case against the defendant. Throughout the movie My Cousin Vinny, Jim Trotter is the prosecuting attorney. In the entire movie he is using evidence and witness testimonies to try to get the jury to find Billy Gambini and Stan Rothenstein guilty of killing the clerk in the store.
In a retributive justice system, the state is tasked with bringing Blanco-Garcia to justice. The state will accuse Blanco-Garcia of murdering Vanessa Pham and hold an adversarial trial to determine whether he is guilty of the crime or not. An appointed defense attorney (DA) will represent Blanco-Garcia at trial. Due process demands that the defendant is afforded legal representation to argue matters of law on his behalf as well as to protect the defendant’s other due process rights. Likewise, the state will also be represented by a legal agent, the commonwealth attorney (CA).
Prosecutors have lots of discretion when it comes to deciding whether or not to charge people. Next, he or she makes an initial appearance before a magistrate. At this time, decisions regarding bail are also made. Sometimes—but not always—the next step is for the defendant to appear at a preliminary hearing, where it is decided whether or not probable cause exists that the defendant committed the crime he or she is charged with. Next, a grand jury hears the state's evidence on the case and may or may not bring back an indictment against the defendant.
Briefly describe the TWO different roles that courts play in Canada. The two different roles of Canadian courts are to make decisions on disputes and appeals or judicial review. The function of the court systems it to uphold the rule of law, resolve disputes, and test and enforce the laws in a fair and rational way. The court needs to be independent from the other aspects of the government, otherwise the decision can be influenced by the government and not based solely on the law and fact.
When a person has been charged with a crime, it's after the police have conducted an investigation. There are many times when the investigation has caused the police to arrest the wrong individual. The accused has the right to have their own investigation conducted by professional detectives working for the defense. Defense attorneys can have their own in-house criminal defense investigator to find facts and evidence that will proclaim their clients' innocence. According to the American Bar Association, the prosecutor is an administrator of justice and advocate. In the Casey Anthony trial the prosecutor had enough evidence to charge Casey Anthony as First-Degree murder. The false statements from Casey Anthony, the investigations from law enforcement, and every evidence presented pointed out that Casey Anthony killed her daughter. The prosecutor used “forensic evidence that they say shows Anthony kept the body of her daughter, Caylee Anthony, in the trunk of her car” (Treffers, Burgess, & Burgess, 2013). Another theory was that Casey Anthony put duct tape in Caylee mouth, and suffocate her.

Pfaff stated that "as long as prosecutors simply use the tough laws as a bargaining chip, not real punishment, legislators can reap the political benefits of looking tough on crime while avoiding difficult financial decisions" (Pfaff, 2017, P136). Prosecutors offer a plea bargain to get rid of cases quickly and not allow offenders to go to trial because they might receive more prison
To do this, they used various pieces of evidence and testimonies to convince the jury of their argument. The jury then decided whether or not Arias was guilty based on the claims of counsels, defense and prosecution.
