1. Title

The title for my proposed Research Project is “An Adolescent’s Right to Health and Development: Law on Consent, Competence and Confidentiality”.

2. Introduction

Adolescence is a transitional stage between a person as a child and a person as an adult. The validity of adolescents’ right to health and development derives its thrust from this transitional phase that adolescence is. Various medical and behavioural studies have confirmed and reconfirmed the fact that adolescence is not childhood in completeness nor it is adulthood in entirety. The very fact that adolescents exhibit mental faculties slightly short of a mature mind also supports the theory that this fast differentiation in the mind of an adolescent leads him/her to emotional vulnerability thereby demanding confidentiality in matters pertaining to adolescent’s personal and private life and its …show more content…

Thus, the interplay of consent, competence and confidentiality plays a significant role in ensuring an adolescent’s right to health and development.

Indian laws being ambiguous and self-contradictory as well as silent and cracked at points where adolescent healthcare needs are raised is my humble submission. I try to assert through my paper that in India adolescent health and development are mere welfare concerns doubting and sidelining disrespectfully the rightfulness of an adolescent’s right to health and development in the 21st century ‘India shining, globalising era’.
