Family Law I-Movie Review Movie: Anjanee by Harryy W. Fernandes Genre: Horror & Drama Review A brief synopsis of the storyline is the chief protagonists are Shivani [played by Manisha Koirala] and Aditya [played by Sanjay Kapoor], a married couple with 2 children, Tanwi Gouri Mehta and Anand Mehta. They are wealthy and live in a mansion. Their idyllic life is shattered with the arrival of Sonia, who has an affair with Adiyta. Eventually, Aditya leaves his family for Sonia, leaving the wife and two kids alone. When it is found out that Sonia is barren, Aditya demands custody of his children from Shivani and approaches the courts for a custody battle. Their marriage was proper solemnized and was valid under the Section 5 of the Hindu Marriage Act, 1955 as there was no objection on the validity of this marriage in the movie as well. They couple had two children and the whole family was going well and was happy. After a few years ascertaining the strange behavior of her husband Shivani found that Aditya, her husband, was having an extramarital affair with a younger, attractive and richer woman namely Sonia. When she confronts Aditya, he admits that he is in love with Sonia and is involved with her thus this extramarital affair was taken as adultery conducted by the husband. Here it was observed that Sonia was unmarried and was well known of the fact that Aditya was also married and had two children. This act of husband can be seen under Section 13 (1) of the Hindu Marriage Act, 1955 which says that Any marriage solemnized, whether before or after the commencement of this Act, may, on a petition presented by either the husband or the wife, be dissolved by a decree of divorce on the ground that the other party has, after the solemnization of the marriage, had voluntary sexual intercourse with any person other than his or her spouse and this is a valid ground under which they decided to get divorced.
