October 29, 2016 The Articles of Confederation VS The Constitution As the Americans declared independence from the English, many knew that to succeed within their new found freedom laws needed to be establish within the government. The first document that was presented in order to create a standing government was the Confederation as it stated the division of power within the states and the congress. The Confederation, however, never succeed in the long run due to various of complications. As many agreements and disagreements were made the congress finally drafted the Articles of Confederation 1781. This documented gave minimal power towards the national government leaving the most important decisions within the states because the people were left in fear of overruling or tyranny if too much power was given to the National Government. Under The Articles of Confederation, it is stated that every state will maintain its independence, citizens will not be discriminated against, full faith a credit was to be given, and the return of fugitives wanted in another state would be granted. Aside from this, little concerning control was given to the actual National Government. The United States constitution was an article created within the Constitutional Convention as the purpose of fixing problems in the Confederation. This document gave the congress a larger amount of power, but still managed to keep the states independent. This factor was very important to the congress due to the prevention of a riot with the people. The Constitution also improved foreign recognition as the lack of support from states led to problems with foreign relations. The Bill of Rights was created due to the constitution also established Checks and balances so no chance of overruling was in sight. The Constitution primarily was an article that was establish as the United States government and laws that we still use
The main difference with the Articles of Confederation to the constitution is having the lack of Central Leadership in which we had didn’t have no national court system or judicial branch and an executive branch to enforce any acts passed by Congress as well being able to have presidential figure to represent America without a representative to conduct foreign affairs especially with Britain at the time. America wasn’t able to deal with internal and external threats since Congress could not draft troops and were dependent on states to contribute forces. There are several differences between the Articles of Confederation and the Constitution. One difference is the government under the Constitution has the power to levy taxes. There were serious financial problems under the Articles of Confederation. Because the government couldn’t tax, we had trouble paying our debts. When the Constitution went into effect, a tax plan was developed.
The debate over the Constitution created much tension throughout the new country. From problems with the Articles of Confederation, western expansion, Shay’s rebellion, problem’s at the Constitutional Convention, slave trade, and the start of the War of 1812 all created tensions over the Constitution but nothing that the greats minds of the time couldn’t handle. The United States’ first constitution called the Articles of Confederation failed. Created in 1777, this document gave the authority to declare war, make peace, conduct diplomacy, regulate Native American affairs, appoint military and naval offices, and requisition men from the states. It could coin money and issue paper currency. This document could not do were levy taxes or regulate trade. The intention of this document was to protect the nation if the British were to ever attack again.
In document 3 George Washington says “ We have errors to correct. We have probably had too good an opinion of human nature in forming our confederation.” He also talks about how the Articles have many problems and how the government gave too much power to the people. The government had so little power, that they couldn’t control the states very well and the states pretty much became independent countries. Since their was no judicial system before the Constitution, the states could practically overturn any law they wanted because Congress could not enforce laws.
The Constitution changed the face of the United States government. However, the United States government was not always run by the Constitution. The Articles of Confederation came before it, but ultimately was decided to be unfit for the needs of the republic due to the lack of power to the central government and the weak bond it formed for the Union. The Constitution transformed the federal system of the United States into the balanced system we use today. The Articles of Confederation and the Constitution were very different documents, especially under the topic of state sovereignty.
The Articles of Confederation, created and ratified in 1781 during the Revolutionary War, was the first basis for the United States of America’s central government. This was a shaky set of laws, yet it evolved into The Constitution of the United States of America. Though The Constitution was created from the Articles of Confederation, there were many differences. Three of these are differences in powers, in purposes, and in effects.
The Articles of confederation and the Constitution of the United States have a lot in common. The Articles of Confederation could not control the nation and were replaced after 8 years by the Constitution. Although, the median age for other nations constitutions is less than 10 years old the Constitution of the United States is the strong centerpiece that has held our great nation together for over 200 years. The Articles of Confederation and the Constitution of the United States were both used as a means for forming a functioning government. However, after a few years the new citizens realized that the Articles of Confederation was not government responsibility for the country and that any changes that needed to be made would have to have an agreement amongst all the states. I will describe four the of the changes between the Articles of Confederation and the current Constitution and why those changes were better institutional designs. Out of this need, the Articles of Confederation were born. They lasted for a short time, but were ultimately too weak to ensure the survival of our nation. We needed a way to keep our nation together, but many people were afraid that a document that gave our federal government too much power would put us in the same position we had just escaped, thus the United States Constitution was born. This document laid out the framework of the government of our nation, laid out the branches of it, its checks and balances, explained its purpose, and very carefully and deliberately named each and every one of its powers. The Constitution did more than that though, it also laid out the basis of the rights of every state of the union, as well as the rights of every citizen of the nation, and stated that our rights are not limited to those listed in the Bill of Rights and the Constitution, rather they are too many to name, and that it is the government that is limited based on what is written in the Constitution.
he Articles Of Confederation and The United States Constitution are very different but also quite similar. They have two very different ways to govern the new world. But these ways are also very similar as well. Whether through ways of governing or individual rights. These documents have many similarities and differences.
Slavery in the U.S. Constitution After the Unites States declared Independence from Great Britain in 1776, they greatly feared a strong national government that would be like a monarchy like the one Great Britain had. To prevent this tyrannical government from happening in the U.S., a convention of delegates from all thirteen states were brought together to create the U.S.’s first written constitution: the Articles of Confederation. Articles of Confederation vs. U.S. Constitution The Articles of the Confederation and the U.S. Constitution are two articles that where written and accepted by the United States as a foundation for their new government. They are both very important documents that have similarities and differences. Some of the main things the Articles of Confederation and the U.S. Constitution have in common is that they addressed the needs of its constituencies.
They hoped to create a better government. The Constitution replaced the Article of Confederation permanently in March 4, 1789. The Constitution created checks and balances between the three branches. It also, established the Bill of Rights, and the first ten amendments of the constitution. The Constitution had to be ratified by at least nine states out of thirteen.
The continental congress adopted the article of confederation, the first constitution of the United States, whose purpose was to create a confederation of states. To this effect, the Articles were purposely written to keep the national government as weak as possible. However, there were many problems that soon became apparent as the Articles took effect.
