The full extent of counterfeit medicine is almost unimaginable in the international. Counterfeit medicine is a global problem which poses a great threat on public health. This study investigates the proliferation of counterfeit medicine in Cebu City. Further, the study finds what are the laws implemented against counterfeit medicine and how the government of Cebu City intervenes with the proliferation and discuss how these medicines are being handle and what happened to the products confiscated after the seizure. This study is a quantitative research which gathers secondary of data from internet sites and some data from the office of National Bureau of Investigation 7 (NBI 7). R.A. 8203 also known as ”Special Law on Counterfeit Medicine” prohibits the sale or offering of sale, donation, distribution, trafficking, brokering, exportation or importation or possession of counterfeit drugs (Sec 4). The purpose of the law based from Sec. 15, Art. II of the Constitution, to protect and promote the right to health of the people and instill health consciousness among them. The state shall also provide for their protection against counterfeit drugs.
In relation to counterfeit drugs describe as drug itself containing label or any part of such drug, bearing the trademark other identification mark or imprint or any likeness without the authorization of the owner, registered in the Bureau of Patent, Trademark and Technology Transfer (BPTTT) in the name of another natural or juridical person (Sec 3 (b) (1)), violation of this section is tantamount to Trademark Infringement provided in R.A. 8293.
