UNDOUBTEDLY rape is the most heinous crime against a woman. The word rape has it’s origin in the Latin term ‘rapio’ which means to ‘to seize’. Thus rape is “to seize or take by force”. According to Black's Law Dictionary rape is, " the unlawful carnal knowledge of a woman by a man forcibly and against her will".
More than half of the world population comprises of women. In spite of this dominant majority, irony of fate lies here. The pathetic condition of women in society is in itself an indicator of the low value set on women’s lives, and their suffering is very well in tune with the social system and life pattern. A total 2,44,270 incidents of crime against women both under I.P.C and SLL(special & local laws) were reported in the country during the year 2012 as compared to 2,28,650 in the year 2011 recording an increase of 6.4% during the year 2012. The rate of crime committed against women was 41.7 in 2012. The crime against women during the year 2012 has increased by 6.8% over the year 2011 and by 24.7% over the year 2008. For many centuries, women and men were not treated equally. After the Civil War, women had many essential successes that helped them earn respect. Women have tried very hard to get to the point where they can be treated with the same respect as men. As of today, women are still not equal to men. Women face violence, discrimination, and barriers in society.
While the laws that govern rape have changed dramatically since the 19th century, the general premise of rape hasn’t. Men are still using the same 200 year old tactics to rape and dominate women. They are exploiting close relationships for an easier rape. Men continue to belittle women by convincing them that they are dependent upon men in order to survive. The issues that Kilbourne is attempting to attack are highly sensitive ones. Therefore, it would follow that her essay would appeal to pathos more than usual. The violence that Kilbourne is talking about affects nearly all women and is something that demands attention. It is true when Kilbourne says, “Most of us become numb to these images, just as we become numb to the daily litany in the news of women being raped, battered, and killed” (430). The Rape Shield Law was enacted to protect the rights of rape victims and to encourage rape victims to come forward that might not otherwise do so for fear of their past sexual history coming to light. Some of these rape victims are afraid that their private sexual history or previous sexual encounters will be brought up in court or become public knowledge. Many times the fear of exposure and shame could prevent victims of rape from coming forward and making a complaint to the police against an assailant. With the introduction of the rape shield law a reluctant victim might be more willing to come forward and file a complaint.

Is our justice system corrupted, racist or is it perfect? Did you know African Americans now constitute for nearly 1 million of the total 2.3 million incarcerated population? This is probably the case because Blacks are incarcerated six times the rate of whites. African Americans are directly targeted and punished in a much more aggressive way than white people. The role of women in literature crosses many broad spectrums in works of the past and present. Women are often portrayed as weak and feeble individuals that submit to the situations around them, but in many cases women are shown to be strong, independent individuals.
