A common misconception is that the death penalty will lower crime rates, but it is quite the opposite. From the author of “Facts about Deterrence and the Death Penalty” came, “ Eighty-eight percent of the country’s top criminologists do not believe the death penalty acts as a deterrent to homicide.” There is no way to tell whether or not abolishing the Death Penalty will affect the way a killer might think; If it will somehow prevent them from committing crimes, but one thing we know for sure, is that Capital Punishment does not reduce crime. Therefore, I state that no individual should receive the death penalty and instead, be sentenced to life in prison. I believe that the most important part of the book To Kill a Mockingbird is on page 282, when Judge Taylor is polling the jury on whether or not to let Tom Robinson free. I was astonished when the jury answered, “Guilty...guilty...guilty...guilty…” The jury’s response surprised and saddened me as it seemed that Tom Robinson would go free, thanks to Atticus’s defense. Atticus destroyed the prosecutor's case with a well thought out rebuttal; the verdict seemed to be blatantly obvious. But even though Tom should have gone free, he was sentenced to death for something, I believe, he didn’t do. In fact, he was very kind to Mayella Ewell, helping her with chores and other odds and ends.
Death Penalty According to the 2010 Gallup Poll, 64% of the United State of America are supporting the death penalty, I as an American am part of that 36% that is against it. I do not believe that we as human being should determine whether another person should live or die. A second reason that I am against the death penalty is for the reason that the accused person could be innocent and normally the accused person only has one court presentation and is only judged by the judge not a jury of their peer, and is sent to death row where they pay for a crime that they haven’t done. The day before John Adams left office, he signed documents to appoint the Midnight Judges, who were Federalists. William Marbury was one of the judges in which he was appointed for Justice of the Peace. James Madison didn’t deliver them, at the request of Thomas Jefferson. Marbury petitioned Madison over the failure of the delivery. Based on a 4-0 vote by the justices, Chief Justice John Marshall announced that although Marbury had a right to his notice, the Supreme Court couldn’t force Madison to deliver them.
The Marbury vs Madison case was a landmark Supreme Court case that formed the basis of judicial review. William Marbury had been anointed justice of peace by John Adams at the end of his term as President. James Madison believed that he should not have been appointed justice of peace. Following this, Madison did not deliver Marbury’s commission which resulted in the Marbury vs Madison case. As acting Chief Justice John Marshall told Madison that what he had done was illegal, but since Marbury’s petition was out of jurisdiction Madison claimed it unconstitutional so the court could not order Madison to return the papers.
