Media system is existed free and no constraints in the world. The number of social networking sites is increasing day by day. It does not have an accuracy of balance between the right of individuals to freedom of speech and to protect their reputation. There are many nations are playing the role of the watchdog by laws and frame the regulations to control and manipulate the function of the media. (FindLaw, n.d) The law of defamation is the essential area of law for every journalist to understand it. In addition, journalists that being sued successfully for defamation may be costly. Remedies in those defamation cases will be the damages which are monetary compensation and injunction that follow the court order. (LawTeacher, n.d) It can say that the laws of defamation are a regulator and watchdog of the media. Freedom of speech and press should achieve the ideal goal from the government and the intervention from the strength groups. In Malaysia Constitution which is Federal Constitution was listed down the freedom of speech but there are others limit that we need to follow including Sedition Act of 1948, the Internal Security Act of 1960, Printing Presses and Publication Act of 1984 and more. Defamation laws affect the work of journalists in Malaysia apparently. The defamation laws just play a role to suppress the freedom of speech, ruling party are holding the ownership and the right to control it. In most countries around the world, freedom of expression does not exist, so there is always war in those countries. In the article “Why the First Amendment (and Journalism) Might Be in Trouble”, the authors, Ken Dautrich, chair of the Public Policy at the University of Connecticut and John Bare, who is the vice president for strategic planning and evaluation at the Arthur M. Do Twitter, Snapchat, and Facebook cover up free speech? People that run media sites, such as Instagram and Facebook have bias and shut down pages if they “Violate their Community Guidelines”. I follow a lot of pages that have been shut down because they say opinions that apparently violent their terms when all they did was say their opinion and express their right to free speech. This goes along with Ray Bradbury’s Fahrenheit 451, when the government is censoring people and not letting them read books.

But the positive interaction of government-press-society does not mean that each party must lose the function of its functional idealism. For if each existence is not approached with independent and interdependent responsibilities and obligations, it can be ascertained that each party will not be able to assume its rights and responsibilities. It means that the government should be given authority, as an authorized and responsible body to regulate the interests and spheres of its citizens. The press must remain authorized to carry out its distinctive social control functions.
We cannot deny the evolution of technologies because due to its development a lot of things are changing day by day. Undoubtedly, social media has its advantages and its disadvantages. The idea of social networks should not be abandoned just because they sometimes have some negative effect on person’s conscience. The disadvantages could be eliminated by raising these issues publicly. The networks are continuously developing and trying to reduce adverse problems.
1.0 INTRODUCTION In the Universal Declaration of Human Rights (UDHR), freedom of speech falls under the Article 19 which is the freedom of opinion and expression. It protects one’s freedom ‘to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers’ (The United Nations, 1948). Article 19(2) of the International Covenant on Civil and Political Rights (ICCPR) adds that the freedom of expression could be ‘either orally, in writing or in print, in the form of art, or through any other media of his choice’. Besides being an individual’s fundamental liberty of expression, Santa Clara University School of Law Professor Russell W. Galloway (1991) states that free speech is the ‘matrix of all other freedoms’.
