Introduction:
The Federal Communications Commission (FCC) is an independent regulatory agency charged with the task of monitoring and controlling interstate and international forms of communications regarding radio, cable, wire, satellite, television, and any sort of video programming for any individual with disabilities (Federal Communications Commission, n.d). The FCC was founded in 1934 due to Communications Act of 1934 thus replacing FRC and currently is ran by 4 commissioners appointed by the President and confirmed by the U.S. Senate. It should be noted that one of the appointed commissioners would delegate the role of chairman, and no more than 3 commissioners may be members of a same political party, nor can any commissioner have financial

The chances of the FCC achieving every single goal is bold but impossible. Every goal with the exception of the first goal is fairly broad in scope and can be measured in a variety of ways thus it is easier to achieve in that sense. The goal of providing 100% high-speed broadband internet to the entire country is much more specific and can be gauged which makes it harder to achieve. This is especially the case in very rural areas as there is no infrastructure or very shake at most to provide high-quality internet. The FCC would have to invest heavily into creating the infrastructure to help support such endeavor and ensure that it can be maintained. It should also be noted that the goal does not mean that the FCC or in this case the Government is providing an internet service but rather creating a discount for primarily low income and rural households. Many advocates have argued to make the FCC regulations much laxer and leave it to the private industry, but I personally think that is impossible to do so. A concept that many don’t realize is that the radio waves that are transmitted is a public good and it’s a sound wave which crosses every border there is (think of the situation like air). This means that regulating radio waves can’t necessarily viewed at a local or state level but rather in a larger national and global scale which further strengthens the FCC’s focus on being a federal agency. However, credit where credit is due, the FCC has been making strides and significant efforts to connect the entire United States with access to high-speed internet even more so during and after the wake of
Net-neutrality is the principle that providers of Internet services enable access to all contents with no prejudice or discrimination against sites or products regardless of the source. In December, the U.S. government repealed the national regulations that prevented “Internet Service Providers from blocking legal content, throttling traffic or prioritizing content on their broadband networks” in favor of a “looser set of requirements that ISPs disclose any blocking or prioritization of their own content.” In summary, the government has decided to change net-neutrality and make it easier to profit from. The government’s want, and subsequent success, to change the strict guidelines by which net-neutrality operated with is supported by the Chairman
The Public Service Commission thought that this ban was necessary for solving the problem of the electrical shortage because having less people under the impression that using a lot of electricity is good can prevent the usage of electricity and therefore causing the circuits to regain power and function normally again. Gas and Electric Corp. found that this ban was not only unlawful, however, ruined their business as well by having an unwanted government regulation used against them in favor for something that wasn't directly the company's fault. It is up to the people on how much electricity they use and Gas & Electric Corp. Was only doing their job my promoting and advertising their products and services. The Supreme Court ruled that the ban on electrical advertisements was a violation of the First and Fourteenth Amendment and this led to the four-step process of determining how commercial speech should be analyzed and interpreted in
In the simplest of terms: the FCC rules mean no fast and slow lanes on the internet, no blocking of content, and no provider throttling your streaming video just because it can. (Hong) The only reason he could be against this is if he wanted to make money off of it. It is hard to fathom that someone would be against an internet where you are protected from getting exploited by the
5 Introduction The Constitutional Convention was called to order so that the Articles of Confederation could be amended. However, the Founders soon realized the Articles of Confederation provided an insufficient platform of which to erect necessary safeguards of democracy including, separation of powers, and federalism. Establishing a new constitution was not an easy feat. Many different clashing ideas would have to be weighed, measured, and agreed upon.
It’s not so fucking simple” (Zelezny, 2010, pg. 481). Fox challenged the FCC’s policy claiming that it violated the station’s First Amendment rights and fell under the category of “arbitrary and capricious“ outlined in the Administrative Procedure Act (5 U.S.C. §702). (Denniston, 2009; Zelezny,
Maureen Ohlhausen, chairman, and Terrell McSweeny are the only two current commissioners (FTC 2017). Deceptive commercial speech has never been granted First Amendment protection. During the landmark case of Virginia State Bd. of Pharmacy v. Virginia Citizens Consumer Council, Inc., the court granted first amendment protection to commercial speech in fulfilling public interest. However, the court provided no initiative to change the unprotected status of deceptive commercial speech (Virginia State Bd. of Pharmacy v. Virginia Citizens Consumer Council, Inc., 425 U.S. 748 (1976); Zelezny, 2011). This form of speech has been ruled illegal in every federal jurisdiction (Zelezny,
SUBJECT: Summary of FCC Rule on Net Neutrality In 2015, the Federal Communications Commission published a rule that classified Internet Service Providers (ISPs) as common carriers. The main decision behind this rule was the idea of “net neutrality,” or the principle that Internet service providers should treat all Internet data as the same regardless of its kind, source, or destination. The concept of net neutrality has been the subject of debate and controversy for quite some time, and now that the digital age is advancing at an even quicker rate, this concept is challenged more and more. FCC recently proposed a new rule that would reverse the 2015 classification of ISP’s back to lightly-regulated information services.
Some of the problems of the Articles of Confederation were congress had absolutely no power. When they wanted to raise tax, an army or even regulate the foreign trade they couldn’t. Congress had no power over the states to enforce the laws. The Constitution ended up giving Congress something we call today Enumerated Powers. An enumerated power is explained in the Constitution Article 1 Section 8 that are often called “expressed powers”.
Mr. Cook said this broadcast was a personal attack against him and demanded airtime for him to be able to respond and defend himself. Red Lion Broadcasting Co. refused to give him airtime. The FCC said that Red Lion Broadcasting Co. was in violation of the “fairness doctrine” which requires that “public issues be presented by broadcasters and that each side of those issues be given fair coverage.” Red
The FCC is responsible with regulating interstate and international communications by radio, television, wire, satellite and cable.” (Federal Communications Commission). Almost everyone takes obscene, indecent and profane broadcasts seriously, and based on the severity of their context, can be punishable by law. Enforcement actions by the FCC in the form of warnings, impose a monetary forfeiture and or the revoking of a stations licenses can be issued after a complaint is filed and a violation has been confirmed.
Our founding fathers adopted the Articles of Confederation as the first constitution of the United States, shortly after gaining independence from Great Britain. The Articles basically established how the federal government would function free of British rule. What the founding fathers failed to see or forecast were the potential issues that came about shortly after the Articles were ratified by the states. The Articles did not give the federal government much power as people at the time were afraid of a powerful central government. The new government was unable to impose any laws or levy taxes on the colonies as each was independent.
Affiliate fees. These are fees that cable companies pay to programming providers on a per subscriber basis for content that they then repackage and sell to consumers. A move like that is what I think that the FCC fears the
The FCC is a government agency that regulates the radio, television and phone industries. The Federal Communication Commission regulates interstate communication for instance wire, satellite and cable, and international communication. The FCC originated from The Communication Act of 1934, which abolished the Federal radio commission. The Communication Act of 1934 was the barrier for all the communications rules in place today. This act expanded on the authority of the FCC to regulate public airwaves in the United Stated.
APPOINTMENT OF GOVERNORS AGAINST THE CONCEPT FEDERALISM Nitin Goklani & Tanwi Pareek Federalism is a political concept in which the sovereignty is constitutionally divided among the Union governing authority and its constituent political units in such a way that they are independent of each other in their own spheres and not subordinate to one another. Now what we see in India is that the constitution is not strictly Federal. According to various critiques, the Constitution has many features which portray that it is Federal with a strong union and the appointment of the governor is one such characteristic. The Governor is the Constitutional head of the state whose role is restricted to act upon the advice of the state cabinet.
The media is a robust topic for conversation in present day American society and rightfully so. Historically, the media has played an enormous role when it comes to exposing injustice and shaping public opinion. This was in full effect during the Civil Rights Era of the 1960’s. Before the rise of modern media, most Civil Rights protests were local and fairly small. However with the rise of television and national news, brutal racist acts inflicted upon African Americans came into the consciousness of many Americans thus helping the Civil Rights movement gain more supporters and increase the pace for the fight for equality.
