THE INTRODUCTION Good morning, my name is Braden Hoheisel, and it is my pleasure to represent the State of Maycomb and to serve as prosecutor in this life-changing case. On August 26, 1936 Mr. Gilmer harassed and disrespected Tom Robison in his court trial. He made false statements about stuff not related to the case and called Tom names. At the conclusion of this case, we hope that after you have heard all the evidence that you will choose the verdict of guilty on this case and the charges of harassment and lying.

Gilmer who let his power change the verdict of the August 26, 1936 court case by abusing his power. While Mr. Gilmer's cross-examining Tom Robison on August 26, 1936, in the Tom Robison vs Mayella Ewell case, Mr. Gillmer made up stuff to make Tom look bad in front of the jury by making up false statements about a previous case Tom Robinson had with the law. Gilmer starts his cross-examination of Tom Robinson by asking him about a previous case he had when he got in a fight with another guy. Mr. Gilmer asked, “what did the guy look like when you got through with him” (Lee 223). Mr. Gilmer starts with this by putting a bad picture in the jury’s mind of Tom by making a false statement that Tom beat the guy up and hurt him when in reality Tom was the one that got beat up. Then Mr. Gilmer goes on to tell the jury “anyone who was convicted of disorderly conduct could easily have had it in his heart to take advantage of Mayella” (Lee 223). Mr. Gilmer says this claiming Tom is a bad guy and he did it, just because Tom has had a questionable history does not mean he is a bad guy anymore. The only reason Mr. Gilmer is saying this stuff is to make Tom look worse than he is in front of the jury changing the outcome of the case. Then Mr. Gilmer calls Tom names like “boy” (Lee 223) and “young buck” (Lee 223) making fun of Tom in front of the whole courtroom. During the questioning by Mr. Gilmer, Tom said aloud for all the court to hear, “I felt right sorry her” by saying those words Tom has dug himself a hole he ultimately did not get out of, for he is found guilty by the jury after a couple of hours. Robinson did not live through his sentence; prison guards later shot him 17 times after trying to escape. His testimony was true and solid until those words came from his
Primarily, we have three witnesses’ testimonies proving Tom Robinson guilty, including Tom’s statement that showed admission to guilt. Mr. Heck Tate was our first witness testifying against Tom. Mr. Heck Tate had stated Miss Mayella was in a terrible condition when he saw her after her father
Gilmer asked him a few questions about the potential crime committed, when Tom tried to explain his side of the story Mr. Gilmer interpreted with “then you say she's a lying boy (Lee 264)?” Then later on when Tom was saying how he just wanted to help her with her chores every once and awhile Mr. Gilmer came back with, “you felt sorry for her, you felt sorry for her (Lee 264),” When he tried to say something back there were times when Mr. Gilmer came back with rude and unnecessary things such as “are you being impudent to me, boy (Lee 265)?” There were many other things Mr. Gilmer said that shouldn't have been said that day. Naturally, Tom would be seen as the guilty party in this situation, but here’s why he isn’t. Mayella Ewell, the so-called victim, Heck Tate, Bob Ewell, and Tom Robinson all had different accounts on what happened on the twenty-first day of November. Heck Tate, the sheriff of Maycomb County, took the stand first in this trial. Heck was dressed formally in a suit and tie. However, when Mr. Gilmer and Atticus Finch approached him to question him, he became nervous and stiff.
The town of Maycomb, Alabama recently experienced a controversial and historical trial on the case of Tom Robinson, an African American man, being accused of raping and assaulting 19 year old Mayella Ewell. Many people from all over packed into the Maycomb courthouse to see the verdict of this case. Tom Robinson was defended by Mr. Atticus Finch, while Mr. Wilmer Gilmer was Miss Ewell’s attorney for this case. Mr. Finch provided strong evidence that Mr. Robinson did not perpetrate this crime. However, Mr. Robinson was unanimously proven guilty and sentenced to the electric chair to be killed as a punishment for this said crime.

On November 21, 1935, the defendant in this matter failed to search, investigate, and document a crime scene. At the finale of the case, and after you’ve heard all the evidence, we are confident that you will return with a verdict of guilty on the poor investigation and documentation.
Members of the jury, this case is about a man that let his dereliction of duty get to him. This happened because Mr. Finch didn’t think he would win the case from the start so he didn’t put full effort into it and just did the case so his reputation would stay good. These events led to Tom Robinson losing his case
AND THEORY Ladies and gentlemen, this case is about a man who poorly defended an innocent black man because he was afraid. If Atticus Finch actually defended Tom Robinson, Atticus was afraid the whole town would start to hate him. Parties
The Tom Robinson trial that occurred during the summer of this year was a result of an accusation of rape against Robinson by the Ewell family. According to Sheriff Heck Tate’s testimony, he was called to the Ewell residence on the night of November 21st. He found Miss Mayella Ewell beaten up and sprawled on the ground. “Found her lying on the floor in the middle of the front room, one on the right as you go in”(190). After questioning by Robinson’s lawyer, Atticus Finch, he stated that despite Miss Ewell’s injuries, a doctor had not been called.
In Lee’s book, it is shown through the innocence of a child that Tom Robinson is not guilty, and that the jury convicted him for no reason other than their own prejudiced values and pressure from other prejudiced townspeople. After the outcome of the trial a young boy named Jem questions “How could they, how could they do it?” and his father answers. “I don't know but they did, they’ve done it before tonight, and they will probably do it again.”(Lee 215).
Gilmer's interrogation of Tom Robinson. Near the end of the cross-examination, Mr. Gilmer asks if Tom is being "impudent" (225) to him while calling Tom "boy" (225), after which Tom responds that he is not. The condescending diction that Mr. Gilmer uses shows that he considers himself superior to Tom, and in addition to him saying that Tom is "scared [of having] to face up to what [he] did" (225), that shows Mr. Gilmer is judging Tom and assessing him as guilty already. Even though there is not enough evidence to determine Tom as innocent, Lee's summation of the testimonies portrays Tom as innocent, yet Mr. Gilmer's assuming accusations cause Tom's apparent innocent aura to shatter. Almost everyone throughout Maycomb thought Tom was guilty just because of the color of his skin. But, the real question was, did Tom Robinson really abuse and take advantage of Mayella Ewell? Throughout the argument Mr.Gilmer used both Pathos and Ethos extensively
Have you ever wondered what a court room means to most people? Well, to most it’s an equalizer for any man or woman present, but there is a flaw to this system. This flaw is bias, the amount of evidence, and witnesses. Today we will talk of whether or not Tom Robinson had received a constitutional trial. If you don’t know “To Kill a Mocking Bird” by Harper Lee, is a telling of age story, about a girl nicknamed “Scout” growing up, while slowly unlocking the secrets of her home town and the secrets of life.
The jury came to the conclusion, with no evidence the offense happened, that Tom Robinson was guilty. Based on the grudges and resentments of those men, Tom Robinson was never going to receive a fair trial with the jury given. ANTICIPATE THE DEFENSE
In Tom Robinson’s court, all the people in Maycomb County were anger that Atticus would help a black person by honestly representing Robinson in a Court as his attorney, “When Atticus makes his summation to the jury, he literally bares himself to the jury's and the town's anger: he "unbuttoned his vest, unbuttoned his collar, loosened his tie, and took off his coat.” (Jones 12) Before the start of the court, Atticus was approached by a group of people who want the intention of injuring Tom Robinson, including Walter Cunningham. But Atticus always was defending Tom; however, Tom fails in this court because of irrational decisions due
