For this discussion, I have chosen the fifth amendment and how it applies or could apply to business in general. The best way that I interoperate the fifth amendment is thus, you will be prosecuted and punished if you commit a crime that you are found guilty of in a court of law. For business, I see two ways that we can be effected, knowing that harsh punishment will be awarded to any business person who breaks the law may very well deter those who thought of committing a business crime. The other way is the opposite, with understanding what is at steak those who look to crime to better themselves in the business environment will be more cautious when committing these crimes in efforts not to be caught.
As for a personal professional life, I like to keep it simple, I understand and will keep up to date on which business practices will land me behind steel bars and I will refrain from participating in those activities. Furthermore, I will make it a point to ensure my peers play by the same rules, for if shady dealings are being used by one of my peers, I would be native not to use their own game against them. I would find some evidence and turn them in, they would pay for their crime and my remaining peers and I would gain from the loss of unhealthy competition.

In this I believe the fifth amendment protects the world of business. Yes, there will be people who will find loops holes and exploit others to better themselves, but there will always be someone there waiting for them when they are
The Fifth Amendment ‘’The fifth amendment is an old friend and a good friend. It is one of the great landmarks in man’s struggle to be free of tyranny, to be decent and civilized. It is our way of escape from the use of torture.’’ -William O. Douglas The first ten amendments, known as the bill of rights, were written to help look after each personś guaranteed freedoms from being violated by the government.
The Eighth Amendment of the Constitution of the United is one of the shortest amendments, but its understanding has caused many debates. Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted (). The 1960s brought challenges to the fundamental legality of the death penalty. Before then, the Fifth, Eighth, and Fourteenth Amendments were interpreted as permitting the death penalty (Death Penalty Information Center, 2015). The eighth Amendment was born from the 1689 English Bill of Rights.
The Fourth Amendment of the U.S. Constitution provides, the ultimate goal of this provision is to protect people’s right of privacy and freedom from arbitrary governmental intrusions. And being searched. Good Thing
Pleading the Fifth Technology seems to come hand in hand with modernity. It has made most tasks that used to take days to complete much easier. Technology has also improved the channels of communication. The invention of the modern day smart cellphone coupled with social media networking has allowed mankind to be in constant contact with one another from across the globe.
Imagine being eavesdropped by the government, while talking a private conversation. This would make people feel unsafe. Katz, a person who experienced it, went to court because of this. The Supreme Court agrees to hear about 100-150 cases out of 7,000 per year. Cases are brought up to the court by the people filing a complaint or the people think their rights has been deprived by other citizens(USGOV).
The seventh amendment gives the right that no trial can ever be brought back up or reexamined by a court again, once proven innocent the accused is always innocent. This protects the accused from the possibility of new evidence or supposed witnesses from emerging after the trial is completed. This amendment does not apply to state and local government. This amendment prompts those involved in a trial to be thorough and intentional when dealing with a case, for once it is closed it cannot be opened. The next amendment to be overviewed is amendment 8.
The fourth amendment allows the NSA to conduct searches of phone records to find evidence of a crime. The NSA has recently went to Apple to try and access suspects phone records, although it requires a court order. Some of the most common requests for phone files are clues for robberies, kidnappings, and suicidal prevention. George Bush created the U.S. patriot act which allowed the government to better access telephone and communications. The NSA was also conducting wiretaps and surveillance.
Last but not least, the famous Second Amendment. Here is what it is about: “A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed”. Pro-gun supporters love to cite the Second Amendment as a proof that it is their right to carry guns in order to rise up against a tyrannical government. However, they are only manipulating the original intent of the Second Amendment for their own profit. Back in the days, the United States had no standing federal army because the founders were afraid of a national standing army consolidating power and the states were expected to sustain a state militia in order to contribute to the national defence.
Which amendments focus on the rights of people accused of crimes? What rights do these amendments guarantee? The Fifth, Sixth, and Eighth Amendment focuses on the rights of people accused of crimes. The Fifth Amendment protects an accused citizen of self incrimination and double jeopardy.
1. No crying 2. No snitching and 3. The most important of them all… Seek revenge. So Will followed the rules.
he fourth amendment was heavily rooted in the legal doctrine. The fourth amendment was created to limit the government 's power.
The United States Constitution was created in September 17, 1787 to replace the Articles of Confederation. Due to arguments between the Federalists and the Anti-Federalists, the two groups decided to add amendments to the Constitution to appease the Anti-Federalists. The condition was that two-thirds of the states had to approve the amendment before it’s added to the constitution. These conditions are still held today and there are now 27 amendments. Amendments in the constitution are important because they give natural rights to people.
The story of Erin Brockovich is indeed one concerning levels of ethical dilemmas. What Erin Brockovich went through in the entire sphere of her job at the law firm with Ed Masry and her case concerning actions of PG&E, depicts quantum of all of the five ethical principles in one jock combined. However, what is of grave appreciation and instrumental value that how she and the people around her, knowingly or unknowingly, portrayed vivid views on personal ethics and contradictions towards internal believes and motives with such brilliance and articulate. Business Ethics itself focuses on two things and two things only, which are everyone has the right to pursue their dream and no one has the right to obstruct anyone else’s progression towards
Carr believed that business was like a game, where everyone put on their game face and hostility to receive the most monetary gain from established laws. Furthermore, Bowie refuted this stance by providing the negative consequences of this adversarial environment. Showing how firms, are utilising trust to succeed at their goals, to greater effect than any hostilities. While Bowie clearly established his stance against Carr, Bowie missed opportunities to nail Carr on other weaker points in his argument for Business Bluffing. In conclusion, the act of lies cheating and deception, skirting the edges of the law just to make a profit, much like poker, should stay as a game and out of
