According to salmand- “Law may be defined as the body of principles recognized and applied by the state in the administration of justice.” In the word of Rosco Pound- What Is the purpose of law? First purpose of law is to maintain law and order within a given society and that has to be done at any cost. The second is to maintain status quo in society. The third one is to enable individuals to have the maximum of freedom to assert themselves and fourth purpose of law is the maximum satisfaction of the need of the people. Sir John Solmand refers to eight kind of law viz, Imperative law, Physical Law, Natural law, Conventional law, Customary law, Practical law, International law and Civil law. The term Constitutional law has been defined by many writers Wade & Phillips write – “there is no hard and fast definition of constitutional law. In the general way accepted use of the term, it means the rule of law, including binding conventions, which regulate the structure of the principle organs of the government and their relationship to each other and determine their principle.”
As far as Indian Constitution are concern, it was adopted by the constituent assembly on 26th November 1949, and came into force on 26th January 1950. With its adoption the union of India become the modern and contemporary republic of India replacing the Government of India Act-1935 as the countries fundamental document.
