In 1936 in Paris, The International Chamber of Commerce defined and published Incoterms, a set of rules to define trade terms. Amendments were added later in 1953, 1967, 1980, 1990, 2000 and finally 2010. As of today, the 2010 version is in effect. The 2010 version states the trade terms that can be used for any mode or modes of transport firstly and only then provides trade terms that can be used for sea and inland waterway transport. The author points out the limitations to the understanding of INCOTERMS excellently. As pointed out ‘old habits die hard’ and buyers and sellers are not willing to update their usage of trade terms that are tailored to contemporary commercial practice. Another confusion the author points out is that the terms are being misunderstood to mean the whole contract. The terms only provide for delivery, risk transfer and cannot in anyway replace the whole contract. The ICC has used extensive research in the area of trade terms to formulate and update the INCOTERMS as they are today. ICC has also used the word ‘domestic’ to include such trade where the distance between the parties is substantially more as compared to neighbouring countries in some cases. ICC encourages and promotes the usage of the terms in commercial trade, however the usage of the terms seem to be declining in the current

They purchase second hand tonnage in an attempt to capitalize on the increased level of demand second hand markets increased the value of it and are willing to pay high prices for them to meet the needs of increasing trade. Shippers are now willing to commit to long term charter parties to lock in rates and secure vessels to ensure that their cargo is transported. The banking sector gets blindsided by the amount of money moving in the shipping market and they begin loosening their lending criteria, abandoning in part or in whole prudent and basic lending principles. They are also not considering security on these loans especially if they have before them evidence of long-term charter
