Introduction
Rape is malum in se. Gender equality is enshrined in the Indian constitution. All men and women are given equal rights and their own junction. Sex is understood as the biological difference between men and women. Rape is such a subdued crime in itself and the victim has to face more enormous consequences than the rape. Rape, the most common form of violence against women has been a part of human culture and is a profound violation of woman’s bodily integrity and can be a form of torture . Concept: In Indian constitution gender equality is enshrined with provision of positive discrimination in favour of women. In modern India women occupy position of leadership in most fields. Even in ancient India women enjoyed status equal to men or even better. The divine personification of feminine power was and is known as Shakti .The reasons for rape include sexual pleasure, socioeconomic, power, sadism, anger, and evolutionary. For example persons in power can coerce mating with little fear of reprisal. In mathematical parlance rape may be described as a function of space and time. For example the definition of rape in US has been revised since January 2013 as “Penetration, no matter how slight, of the vagina or anus with any body part or object, or oral penetration by a sex organ of another person, without the consent of the victim” . A plain reading of Section 375 of the IPC would make it apparent that the term "sexual intercourse’ has not been defined and is, therefore, subject to and is capable of judicial interpretation. And the Section also does not in any way limit the term penetration to mean penile/vaginal penetration. Limiting the understanding of "rape" to abuse by penile/vaginal penetration only, runs contrary to the contemporary understanding of sexual abuse law and denies majority of women and children access to adequate redress in violation of Article 21 of the Constitution …show more content…
