Citizens who cooperate with any law enforcement officer will end up well because no use of force or breaking of the law was committed in the situation. Unlike other cases some citizen seem to dislike officers, which leads them not to comply with officers and that leads officers to make quick decisions to not let these citizens get out of control. According to the article Organizational-level police discretion states that, “Thus,
As a law enforcement officer, I look at things impartially and do not let my personal feelings get involved. However, Underhill did not do the same thing in this article. It shows obvious bias against law enforcement techniques of which Underhill has no knowledge of. I have been in law enforcement since 2004 and I am quite used to criticism, and can respect that others do not understand what I do and why law enforcement operates in a specific manner. I can also respect that other do not agree with how things are done.
Search and seizure law is actually one of the detrimental issues in the criminal justice system. Many officers are sometimes faced with constraints and are not able to work properly given that they fail to understand and distinguish between situations when search warrant are required ( Del, 2014). In incidents that have lawful arrest as well as when there is a plain view exception. In areas where consent is given by a person in authority, there is no need for the search warrant required together with the police stops and frisking a person whom they have a reasonable suspicion on of an act that is equated to a crime. Another example is when a situation is an emergency and there is a hot pursuit given the evidence may disappear before the warrant
While there might be times where discrimination was involved in the lack of promotion for individual, however, this particular case study seems to lack the ability to truly provide how this is possible. According to Robinson (2010), Prima Facie involves the process of having sufficient evidence before trail in a lawsuit or in some situations criminal prosecution cases (p. 27). Based off the information provided in this particular case study it would see that Carol is in a bit of a bind regarding Prima Facie. It does not appear that Carol has sufficient evidence to prove that there is illegal discrimination. While it is unfortunate that Carol was not selected for the position that she desired, it is challenging to prove if there was indeed discrimination
The book gives examples that show us that at this time, people didn’t realize that differences make us special. There are also other people in the book that are discriminated, but they are discriminated nearly as much as Crooks is. I think that it is unlawful, even at this time period. Discrimination is for people don’t know that differences make us
The idea of needing informed consent is really a basic idea when it comes to the ethics behind donating, but the idea that’s really surprising is that “…the Common Rule doesn’t actually govern most tissue research” (Skloot, 2010).This is surprising because the rule is supposed to be there and be enforced and since it is not enforced many people may have their rights violated. The other ideas of the HIPPA regulations and other consent precautions may help to deter the violation of rights; however there are still many issues that are widely disputed such as the family changing their mind after their loved one has past and whether or not that’s admissible. The other idea of money is also very prevalent issue because the commercialization off of donated materials can be considered unethical. If you look at patients who decide to donate their body to science they looked to make medical advancements possible. A profit made off donated tissue can in a sense be compared to companies earning a profit over the goods that are donated.
This will be explained in detail below. The police in more than one instance in their career have come face to face with many scenarios in which their lives were in danger. Many security officers have lost their lives in the line of duty. Whereas the use of deadly force is illegal, there are exceptions to this law, especially in the event of self defense.
Jay Wilders played his case well enough that he was not put in prison, but Adnan couldn’t say the same. Adnan must have been one unlucky of a person. It does seem in some parts of the case Adnan did some pretty strange things. Jay’s constant changing of his story should have been taken into consideration a little more though. There is a lot of “what if” or “maybe this happened” on the story that makes a difficult end result of figuring out who actually did the murder.
prosecution, which led them to believe that there were many issues within the system that led to the wrongful conviction that needed to be fixed so another minority was not charged with a murder that was not committed by them. The Inquiry found that the investigation was not done suitably for the standards that the police, and the Crown have. The case’s evidence was insufficient due to lack of investigation at the crime scene, of the witnesses, and of the charges pursued. There was also an insufficient amount of sensitivity of this case due to the fact that it was the prosecution of a visible minority and the lack of training done on the respect to sensitivity on visible minorities. As well as the absence of sufficient review led to the wrongful conviction because they didn’t review the first eyewitness reports and relied only on the second report, which were influenced by an incompetent and unprofessional
The current criminal justice system has implemented countless policies that are unsupported or are determined ineffective by research and evaluation. Research and evaluation play an extremely limited role in policy making. Rather than having policy supported by empirical testing our current system promotes policies that are designed to win the approval of organizations and individuals that can promote polices and accelerate their implementation. When research and evaluation does not provide specific answers or raises more questions, it causes policy makers to dismiss research. Research often provides complex answers to our complex crime issues and this does not allow for policy makers to create quick fix policies for crime issues.
As mentioned before, mandated reporting has been shown to actually make women feel less safe. Confidentiality issues arise with mandatory reporting and may cause turmoil in the patient/health care provider relationship. Victims of Intimate Partner Violence may be reluctant to pursue medical support in emergency situations for this reason and many others. Other reasons that victims of Intimate Partner Violence may be reluctant to pursue medical attention may include that the victim may truly believe that he/she can handle the situation on their own, or the victim may also fear disciplinary abuse when the abuser learns that the abuse was reported. There are currently no laws that one-hundred-percent guarantee the safety of a victim of Intimate Partner Violence (The Association of Women 's Health, Obstetric and Neonatal Nurses, 2015, p. 407).
Court System Controversy Although there is a standard for courtrooms and how they should function it is, nevertheless, unrealistic and unable to be upheld due to bias, prejudice- either conscious or subconscious, and stereotyping. Initially, bias is using personal experiences to hold strong emotions toward a variety of groups of people. Bias can affect the court system in countless ways.
Ms. Johnson Enjoyed reading over your post this week as well as your experience in the candy store, I too love hot candies for the record. As a law enforcement officer, I can attest that the language barrier between law enforcement and the members of the Hispanic community could use some work. Within my organization there are specialized training classes that are offered for law enforcement Spanish. The course material deals with many of the common phrases use between law enforcement and the Hispanic community.
Why do Law Enforcement Officers Receive so Much Hate? In recent history, it has become significantly more obvious that law enforcement agencies and officers are targeted by a vast amount of the community and media. It seems that everywhere we look, there is a story brewing about police brutality or police inequality. Thanks to the available technology more and more people are pulling out their phones and filming law enforcement officers, on duty, losing their cool and attacking the accused individual during an arrest.
