On March 31st, the defendant, Mr. Ernie Miller was arrested on the charge of 2nd degree murder. Second degree murder is where the murder was not premeditated or accidental. (Reuters 2016) Accidental is considered manslaughter, while 1st degree murder is a planned killing. The defendant was arrested on the charge of second degree murder because his alibi for the death of Mrs. Miller does not coincide. Leading us to believe that he is the culprit of the crime. The defendant has several alibis that do not match the story that he told us. The defendant claimed that he was mowing his yard like he always does. I believe the day started as any other day in the Miller household. But today, Mrs Miller got the mail late afternoon. Looking through the mail she found the envelope from Mary Eckhert. This devastated Mrs. Miller, unsure if her husband was cheating on her she was going to drive to the address to find out. Before she left the victim confronted her husband in the front yard about it. They got into an argument, one that lead to be very brutal. The defendant, out of rage started to hit his wife. She fought back and was scratching at him, grabing at his arms. Able to pull off his watch, where it landed in the front yard. This is also how the victim had human skin under her finger nails. The defendant beating her is how she got all the bruises on her body, from her chest to her back. The victim was most likely dead before she made it to the back of the house. To plot the murder as an accident the defendant drug the victims body by her wrists, through the gravel driveway to the back porch. This explains how she ended up with the scratches on the back of both calves, and how the wrists of the victim were wrenched out of joint. Allowing us to understand how the presence of liver mortis occurred. Once the defendant drug his wife to the back porch he staged it to seem like she fell. He crushed some of the beer cans to make it appear as if she got drunk and tripped. Wanting to cover himself up he took the rake, and covered the tracks of dragging his wife through the gravel.
