Pendekatan Konseptual (Conceptual Approach) Pendekatan ini beranjak dari pandangan-pandangan dan doktrin-doktrin yang berkembang di dalam ilmu hukum. Pendekatan ini menjadi penting sebab pemahaman terhadap pandangan/doktrin yang berkembang dalam ilmu hukum dapat menjadi pijakan untuk membangun argumentasi hukum ketika menyelesaikan isu hukum yang dihadapi. Pandangan/doktrin akan memperjelas ide-ide dengan memberikan pengertian-pengertian hukum, konsep hukum, maupun asas hukum yang relevan dengan permasalahan. 3. Toulmin Method is the way to argue! It can be utilized to address various types of audience (colleague, acquaintance, employer, teacher, sponsor, etc.) and for a variety of purpose using any medium (essay, blog, letter, tv program, reports, policy drafting, etc.). It allows us to break an argument into its most basic elements—present a claim, warranted with relevant evidences, appropriately making the connection between the two through inferential leap—then test each component for accuracy, efficiency and credibility. By using these criteria for testing, we can analyze the evidence thoroughly in order to determine whether or not such claim holds water.
The psychological theory calls for a new type of education and training. It is expected that more attention should be paid to the development of individual potential, especially potential of humanity, understanding ourselves and others, the satisfaction of basic human needs and growth toward self-actualization. Too often the educational process inhibits intuition and creativity, instead of developing them - however, some students improve the quality of education due to their strong intention. The process of education should focus on the theory to a lesser extent and more - on the results: the development of understanding, the ability to reason and argue, knowledge of how to live (financial education, ethics etc). The universities pay more attention to courses, which explains how to teach rather than how to live.

CDT considers that, “…a form of knowing always consists of a relationship or temporary equilibrium between the subject and the object in one’s knowing” (Kegan, 2009, p. 53). Kegan’s constructive-development theory is based on the key ideas of people making sense of the reality in which they live and that they can develop over time with appropriate developmental supports. Kegan’s (2009) theory consist of five stages “of knowing”.

This literature review will be covering the topic on research paradigms. There are three major paradigms in the research paradigms which are the positivist paradigm research, interpretivist paradigm research and critical paradigm research. Each research paradigm has its own strengths and effectiveness due to their unique features which are specific to their particular approach as well as weaknesses. All researchers have their own beliefs and methods while conducting a research. Therefore, the ways of research studies conducted are vary.

2.0 SITUATION ANALYSIS Below are Malaysian banking industry’s external environment assessment using Porter’s 5 Forces Analysis. For the purpose of this assessment, 3 top-in-the-league existing domestic banking groups in terms of asset size have been chosen i.e. Maybank, CIMB, and PublicBank. All 8 domestic banking groups have operations in all the 3 segments of banking businesses namely Commercial, Islamic, and Investment bank. Upon analyzing and assessing their immediate surroundings, the banking groups recognize the following important factors that would impact on their competitiveness. THREAT OF RIVALRY AMONG EXISTING BANKS • Too many players in the industry; Each banking group has to contend with 7 other domestic banking groups and 30 other banking intermediaries both local and foreign, comprising 19 Commercial, 8 Islamic, and 3 Investment banks.
The Malay laws (Adat) Malay customary law is called “adat”, is a word came from Arabic. Adat in general means a right to conduct an in common usage, it stands for a change of things all connected with proper social culture and behavior.
