Rape: And How It Affects The World Today Rape is a word that brings a lot of tension. But usually the word is used incorrectly or in the wrong way. The definition of rape is; a type of sexual assault usually involving sexual intercourse or other forms of sexual penetration carried out against a person without that person's consent. In the United States nearly one in five women have experienced rape in their lifetime( center for disease control and prevention). Because that it is such a big crime and also it is a growing problem. This special court will scare of potential fake accusers, because there will be a punishment equal to what the man she accused would have received. Because the overall purpose of having a court and going in front Of a judge is for justice to be served. This new system would not only add more trust to system that’s losing it from the people, but it would be a closer step to justice. In this new system there would be a lengthy investigation into the accusers allegations. Also things like checking personal relationships between the accuser and the person being accused. These things are already carried out but in this new court they would be stricter guidelines in making sure they are complied

Rape is something that many warn us about and tell us to be careful about. What many do not realize is that it can happen in a matter of seconds and there is nothing that can be done to stop it. Often it happens, but people find it difficult to report it because of the person who committed the crime, this was the case in the book Missoula by Jon Krakauer. The book begins with a woman, Allison Huguet, who was raped by a member of the football team in the University of Montana, Beau Donaldson. This case was not the first incident to happen in this city and the author does a great job in letting his readers be aware and know it has happened before.
This way the defendant and their attorney would be able to see if they actually have enough evidence to win the case in court. This would element most of the innocent people pleading guilty out of fear of long prison sentences like what Mr. Gampero did. The second thing I would change is that if the Judges or prosecutors make treats to put someone in prison for a long period of time if they do not take the plea then the case must be thrown out of be tried by a different jurisdiction. In the book, Missoula: Rape and the Justice System in College Town, by Jon Krakauer, the reader delves into how rape and sexual assault are treated in the town of Missoula, and the University of Montana. As the reader, we are informed on how the university, the police department, the district attorney’s office, and the community reacted to these rape and sexual assault allegations. We see how the criminal justice system has failed the victims, and are forced to live with what happened to them, while their assailants are free of any burden. The law is set in place to protect people from victimization, but when the men, in this book, are not legally held accountable, then any woman, or man, is more susceptible to victimization. An estimated one in four women are sexually victimized during their college years. (Schwarz, Jill, et al., 1). Turner getting a light sentence just makes this statistic more real, the victim will be looked at in the future as just another statistic because of the little that was done about it. The victim was intoxicated at the time of the assault, Turner was also. This often makes the case much more difficult, “A common stereotype of sexual assault on college campuses is that the victim could have partial responsibility if they had consumed drugs or alcohol prior to the assault” (Schwarz, Jill, et al., 2).
The correlation from the countries highlighted with the issue at hand is society’s global response, which is ignoring the issue. Victims are have self-learned through society’s response towards sexual assault and rape is to keep quiet and to be ashamed that it happened to them. Victim’s result to blaming themselves and thinking things such as: “I drank to much”, “It happened because of what I was wearing”, or “I didn’t fight back hard enough”. In countries such as the Democratic Republic of Congo and Dar Fur sexual assault and rape cases are not talked about or ever recognized, but used as a weapon of war. In Spain and the United States such cases can be brought to trail but are extremely hard to try in court.

The legal system should be trusted to determine guilt or innocence. In my first anticipation guide I found this to be true, but after reading The Crucible I completely changed my mind. I think that the courts should be trusted to an extent. I believe this because the courts are run by humans and humans make mistakes.
A fair and unbiased court system is necessary for the legal system. The role of the court is to correct any injustice, not to compound it. When prejudice and corruption leak into the courts, what recourse do we have for eradicating them from society? Our judges must be stalwarts of integrity because the power to move our country forward or hold our country back often lies in their hands. Judge Persky had the power to bring justice to a victim, to help her and her family move forward.
*Throughout the decades there has been many changes and innovations in the criminal justice system. Reformers and legislators in the past decades have worked hard to create better laws that diminish most loop holes for defendants. This method can be observed through the evolution of rape trials over time. From Rape Shield Laws to the Rape Reform Movement, many changes have been made in the justice system to protect victims and to accurately convict rapists. Some of these advancements helped victims to accurately convict their rapist, but some of them negatively impacted rape trials and accusations.
In society and college campuses, sexual assault occurs quite frequently. According to an estimation one third of women experience a forced sexual experience at least once in their life and most of the time it occurs in colleges. Men have also been reported to be victim of sexual assaults mostly by other men. Most of the time the sexual assault is planned and perpetrated by a third person, who is known to the victim of incident. Drug and alcohol use play role in this issue and contribute to the problem as most of the time the victim and perpetrators are under the effect of alcohol or any other drug during the incident.
“Although concerning sexual practices between adults and children have existed throughout history and across cultures, whether such behavior was conceived of and defined as ‘abuse’ has been dependent on the societal values of the particular period” (Denov, 2004). In today’s society, sex offending has become an increasingly, concerning phenomenon that individuals must become more aware of. Although generally regarded as a male phenomenon, over time, female perpetrators have become equally important as male perpetrators. Due to the lack of public awareness, female sexual predators go unreported. As a result, society must become more aware of female sexual perpetrators, as many incidents of females assaulting both young men and women have gone unreported for some time.
There are numerous definitions of rape culture. The most accurate definition of rape culture is, “a complex set of beliefs that encourage male sexual aggression and supports violence against women . . . In a rape culture, women perceive a continuum of threatened violence that ranges from sexual remarks to sexual touching to rape itself. A rape culture condones physical and emotional terrorism against women as the norm . . . In a rape culture, both men and women assume that sexual violence is a fact of life, inevitable.”
