It is one of the element of consideration for an agreement to become a contract but must both parties should provide a consideration then only can entered into a contract. It is a Carbolic acid that was a rubber ball with a tube fixed to its opening. Smoke Ball claimed to be a cure to influenza and many other disease. Flu pandemic they estimated that have killed one millions of people. Thus, the company was published an advertisement about the smoke ball would cure people’s flu, and if it did not work buyer would receive 100 pounds. Carbolic smoke ball will be paid for those who contract after using the smoke ball three times in daily for two weeks and if still increasing plague influenza cold or any disease caused by taking cold. Carli was interested with that advertisement and believe that for the invitation to treat so she go and purchased one pack of the smoke ball following the instruction. Latter date she had an attack of influenza. After that, her husband was helped his wife asking Carbolic smoke ball company for the compensation of 100 pounds as a promised in the advertisement.
