Whether passive smoking at home is violative of children's fundamental right to have clean environment or their right to have a healthy life? Should the International community as a whole pass a model law taking care of infringement of this fundamental right of children?

Objective of the Study Though, most of the nations have incorporated appropriate laws that restrict or ban or even punish smoking by an individual at a public place. Not a single example is found after due research on the subject that address the ill effects of smoking on children at home. Even otherwise children are not expected by any stretch of imagination to lodge a caveat against their own superiors at home. That requires further research on the subject. We the people of India have reserved to our favor a fundamental right while enacting our constitution by virtue of Article 21 (Indian constitution), Declaration of Independence (USA), Bill of rights 1686(UK) etc, whereby no person can be deprived of his life. Secondhand Smoke often paves way to several economic, psychological and social problems. In very young children, Secondhand Smoke also increases the risk for more serious problems, including sudden infant death syndrome (SIDS). Most of all “There is no risk-free level of exposure to secondhand smoke”. Studies done by CDC show that children exposed to second hand smoke have about 30% higher odds of being born prematurely.
