On the indicated date and time I Deputy Garcia #618055 was assigned to staff station 620 at North County Correctional Facility (NCCF) when I heard a loud thud which is consistent with that of fighting. I saw Inmate Lopes, Juan #3456712 (later identified as suspect/victim 1 (S/V)) and Inmate Henry, Chuck #2345678 (late identified as suspect/victim 2 (S/V)) on the ground by the day room punching each other on their face and torso. I put a radio broadcast of a minor 415 inmates in dorm 623 with my county issued radio (minor 415 is a common radio code in our facility which indicates a fight is in progress or just occurred). I also requested additional personnel, Sergeant and Senior to my location. I ordered S/V1 Lopes and S/V2 Henry to stop fighting and they complied. Under the supervision of Sergeant Smith #126458, Deputy Jones #220456 and I entered dorm 623 and searched for S/V1 Lopes and S/V2 Henry. 10 Investigative Skills (7PA0006337) - Officer Stark responded to a PC211-Robbery radio call at 1038 E. Colorado Blvd. The comments of the call stated 2 Female Asians and 2 Male Asians pushed the Victim out of his wheelchair and took his wallet containing $25. Stark responded to the location, even though it was out of his beat, and asked me if he could handle the call. I advised the beat Officer that we would handle the incident for training. As we entered the Rite Aid, the Victim was sitting in his wheelchair directly in front of the exit.
At 11:35 on August 27, 2016 (8/27/2016) RA Eric Lovett was walking down the 3rd floor of Davisson doing his 11:00 round when Davidson room 319 was noticeably loud therefore prompting him to knock on the door. Resident Gillian (ID....) opened the door. Resident Nate billings (ID...) then projectile vomited prompting RA Lovett to enter Davidson room 319.

On 5/27/2018, I was dispatched and responded to 5446 Quist Drive reference to a disturbance. Prior to arrival I was advised via radio that a 14 year old male subject was brandishing a weapon towards others. Upon arrival I met with Edward Lohr, who was standing in the driveway of the residence. Edward advised that his girlfriend’s son, Seth Hayes, was lashing out and acting violent. Edward stated that Seth has been elevating his level of violence over the past few days.
On Saturday 09/06/16 at about 0530 hours Elizabeth Cervantes-Hocking came into the lobby of the Auburn Police department to provide a statement. I contacted Elizabeth in the lobby, and she stated she wanted to provide a statement for this case because she believed the Police did not get the full story the night of the incident. I obtained a video statement from Elizabeth using my department cell phone and the following is a summary of that statement. Elizabeth said on 07/09/16, the night of the incident, her roommates decided to call the Police because she was screaming. I asked Elizabeth what she was screaming for, and she said she had a long day, and she was in an agitated mood.
On 04/14/17, at 4:30pm, I Deputy Warden N. Christian was dispatched to the area of Carnation Drive and Blue Bonnett Drive on an injury-possible dangerous or vicious dog to a minor. I arrived at the location and was met by dog owner Christine Belcher and Blendon Township Police Department (BTPD) Detective Sergeant E. Moynihan. I asked what happen, Ms. Belcher stated that her daughter Daisha Decree were walking their Rottweiler name Bolt when victim Victor Schuetz asked to pet the dog, Ms. Decree give permission. At approx 1:15 pm ON 8-29-16, I was sitting at my desk in my office with the door closed. I heard the raised voice of someone I didn 't recognize yelling repeatedly, "get your hands off me" and similar variations of the demand. I did not hear any other voices. I then opened the door and left my office to find Ofc Jaques searching a male black subject who was now found to be the source of the yelling. Ofc Jaques could be heard sternly but calmly giving orders for the subject to comply with his orders in order to be searched prior to being held in the nearby cell.
Officer Perez reports being dispatched to a disturbance at 11 Langton. Perez arrived on scene and met with Ann Mcelroy that stated she lost her phone and found that 2 kids had possession of the phone and was able to get the phone returned to her. Mcelroy stated she wanted to make a report of her phones information had been erased and was concerned of any personal information that was possibly had been taking prior to her getting her phone back. Perez had Mcelroy complete a witness statement form.
On 8/18/2017 at 1950 hours, FTO Buckley #1537, Officer Kenyon #189, and I responded to 20th St. and Shotwell St. regarding a call of an (S1) unknown male suspect possibly kidnapping an (M1) unknown female. On arrival Officer Buckley activated his (BWC1) body worn camera which was later uploaded to evidence.com. On arrival, I observed no unknown male suspect and unknown female at the location. I located (RW1) Joseph Donohoe at the south east corner of 20th St. and Shotwell St. Donohoe said that he had observed a (U1) grey Toyota Corolla with partial licenses plate 6VX role up onto the sidewalk of 3363 20th St. The unknown male suspect got out of the corolla driver side door, approached the female who was walking along the sidewalk and grabbed her by the arm say, “Fuck you bitch!
On 02/08/2017, I, William Van Scoter, was working as a police officer for the Wichita State University Police Department, in Wichita, Sedgwick County, Kansas. At approximately 1520 hours I was told to interview a woman who was to believed to have been sexually assaulted. I arrived at the University Police Department's lobby and was met by a female and two males. The female was later identified as Terry Giang. Giang was going to be interview by Detective Jeff Rider
On 3/17/17 at 1005 hrs, I was dispatched to the PD lobby in reference to harassing phone calls. Upon my arrival, I made contact with the complainant Victoria Wert and her boyfriend, Bradley Palmer. Wert advised Palmer’s ex-girlfriend, Alexus Smith has been texting her since 9/27/16 to 3/17/17, during this time Wert advised she did not text her Smith once, and her text messages are rude and unwanted. Wert advised she did not receive any concerning messages until 3/17/17 at 0930 hrs.
On 09/18/2016, at approximately 2148 hours, at the Durango Jail located at3225 W Gibson Ln Phoenix, AZ 85009 an Inmate/Inmate fight had occurred in Durango 3 B Pod between Inmate Moothery, Naz T303229 and Inmate Sams, Worine T284566. Upon entering Durango 3 B Pod, Inmate Sams approached Inmate Moothery and begun fighting by Durango 3 B Pod door. Multiple strikes were thrown by both inmates until Inmate Moothery had fallen to the Pod floor. At that time Officer Serrano approached the pod door and gave both inmates commands to stop fighting. No radio call was made due to both inmates complying with the orders given.
According to the Eighth Amendment, cruel and unusual punishment is prohibited. For this prohibition to be significant throughout society in which confinement is the essential method of criminal penalty, it is essential to establish when prison conditions are cruel and brutal. While prisoners may have lost their rights to freedom in the light of their crime and conviction, despite everything, they remain to hold the same constitutional rights as free citizens do, with certain exceptions. The special cases include rights that would cause disagreement with the prison facility and system’s ability to safely, adequately, and proficiently run the establishment, those that would risk the wellbeing of the staff, the public and/or others near.
