Would you confess to a murder you didn't commit? Curious? Here's the ongoing case against Steven Avery. Steven Avery is a man from Manitowoc County, Wisconsin, who was wrongfully convicted of sexual assault and attempted murder in 1985. He was sent to prison for 18 years before being exonerated in 2003 from DNA evidence. But again in 2005, Steven Avery was arrested for the murder of Teresa Halbach, a 25-year-old photographer. His arrest gained media attention quickly due to his previous arrest and his family being on the news defending her son for being falsely accused. Many civilians have questioned his arrest and are involved with this case along with his 16-year-old nephew Brendan dassy, who was also accused of murdering Teresa Halbach. This essay will conclude with the evidence of why Steven Avery and Brendan Dassey are not guilty of the Teresa Halbach murder. The evidence used to prosecute Steven was circumstantial evidence. No fingerprints were pointing to Steven or Brenden at the “crime scene”. Even when Michael’s new defense team, through the innocence project, found a crime that was eerily similar to the method of murder and subsequent events to the one that Michael was convicted of, the new prosecutor in Williamson County fought hard to keep DNA testing from taking place, even stating that they objected to the testing now because the defense hadn’t requested it before (Morton, 2014). They also find problems with evidence involving Teresa's RAV4, which was found on the Avery property, saying that there was a car crusher on location in the Avery Junkyard, and that any reasonable person would have destroyed the car, since they would’ve known that it could have been used as evidence against them. A great point is also brought up by them regarding Steven's blood being found in the car, saying that there were no fingerprints found in the car belonging to Steven, and that he would have needed to wear gloves, and even if he had worn gloves, then there would have been no way possible that he could have bled from his finger. It also doesn't make sense that the police suddenly found evidence in Avery's garage on March 1st of 2006, the bullet casings, even though they had been searching for 4 months prior without finding a shred of physical evidence. Lenk was also there when the search of the garage had happened, even though he was never even authorized to be there. And since he had mishandled a previous case that involved Steven Avery, which led to a wrong conviction that landed Steven Avery in an 18-year prison sentence for rape, a crime he didn’t commit, he was deposed as a result and relieved of his duties while also being sued by Avery on the basis of his wrongful conviction.
This has led many people to believe that Avery was framed and there is still a murderer on the loose whilst others believe that he wasn’t given a fair trial no matter his innocence. They believe that there may have been previous bias and bribery in the jury because of Avery’s criminal past. Some also protest that Dassey was manipulated and brainwashed into admitting a crime that he did not commit. There is also numerous theories regarding a stolen blood vial of Avery’s that his blood was planted in Halbach’s vehicle, that the keys were planted by officers during 6-day search of the Avery property, or that the remains were scattered by an unknown source. There is nothing as of now that proves or disproves that Avery and Dassey were not involved in the murder of Theresa Halbach.
At the trial, Steven pleaded not guilty for the entire thing, but there were three pieces of evidence securing the conviction. The first piece of evidence, was that Lynne died before 7:45 p.m. This was crucial because Truscott was back on the school grounds at 8pm, so if Harper had died past 8pm, Truscott would have had alibi. Although this evidence was backed up by Dr. Penistan, who had performed Harper's autopsy, and stated that based on the contents of Lynne's stomach, he believed that she died before 7:45 p.m. on the night she disappeared. Episode seven of Making a Murderer begins with Steven Avery’s father, Allan Avery exclaiming: “They set him up!” Ironically, there is a decent amount of evidence to prove that—in this case—the “good guys” may not be so good. Due to the Avery lawsuit against Manitowoc County Police Department, Manitowoc police were not supposed to be on the Avery premises. But they were, and that car key in Steven Avery’s bedroom was found by police that were not supposed to be there.

Later in January 2002, the Justice minster appointed a former Quebec judge, Fred Kaufman, to assess the case which he later reported that there was a miscarriage of justice in Steven's case but there wasn't enough new evidence to exonerate him. On October 28th 2004, the Federal Minister of Justice, Irwin Cotler, referred the case to the Ontario Court of Appeal for review saying there was reasonable basis to conclude a miscarriage of justice occurred in this case. Witnesses also kept altering their stories at trial from the original trial to the new trial giving the prosecution ammunition. Steven gave his case to the Ontario Court of Appeal on January 31st, 2007 which helped overturn his conviction 8 months later on August 28th, 2007, declaring the case a miscarriage of justice. However, the judges go on to say that "the court is not satisfied that the appellant has been able to demonstrate his factual innocence."
