Similarly, the Child Abuse Prevention and Treatment Act (CAPTA), which is a federal law that will be discussed in detail later in this dissertation, defined child abuse and neglect as “any recent act or failure to act on the part of a parent or caretaker, which results in death, serious physical or emotional harm, sexual abuse or exploitation, or an act or failure to act which presents an imminent risk of serious harm” (HHS, 2003, p. 44). All of the states in the U.S. have used the definitions developed by the WHO and CAPTA as the basis of their state
Mistreatment of children is not a new phenomenon. Indeed, during the recent years, harassment against child has shown an increase in the public’s eye. There are many factors related to child maltreatment. It has four general categories of child abuse now recognized: physical abuse, sexual abuse, neglect and emotional maltreatment. Each category, in turn, covers a range of behavior.
"Child Abuse and Neglect" says that Physical abuse can include "striking a child with the hand, fist, or foot or with an object, burning, shaking, pushing, or throwing a child; pinching or biting the child, pulling a child by the hair or cutting off a child’s air." However, physical abuse is considered to be a use of punishment in wrecked as well as normal families such as the use of physical force with the intent of inflicting bodily pain, but not injury, for the purpose of correction or control or discipline. Yet, there is a thin line between physical punishment and abuse which many parents seem to lack notice of. "Child Abuse and Neglect" explains that the level of force used by an angry or frustrated parent can easily get out of hand and lead to injury. Emotional or verbal abuse is one of the worst forms of mistreatment due to its invisibility.
Abuse is another thing that has been linked, to problems in a child 's development. The earlier abuse and neglect occur in a child 's life the more severe the impact. Furthermore, the stage of development, while the abuse occurs will influence the type and severity of the consequences. Additionally, the more chronic and long lasting the abuse and neglect, the more harmful it is. Every type of child abuse is more likely to cause emotional problems to a child or make them to distrust on adults. The effects of child abuse depend on how frequently it occurs, the age, physical condition, gender, and the type of abuse the child has been suffering. When children are abused physically, their behavior and school performance change tremendously because they start experimenting psychological disorders which lead them to learn slowly. Children who have been abused at home, are more likely to spend their day outside by leaving early and going back late because they feel more secure on the street rather than at home. When physically abuse, a child appearance also changes because of black eyes, broken bones, bruises mark and so on. Similarly, when children are abused sexually they may develop eating disorders by gaining or losing weight, change their appearance during pregnancy, or gain difficulty walking or sitting. Many adults that have been sexually abused in their childhood are more likely to engage in prostitution because of psychological trauma. Likewise, physical and sexual abuse, emotional abuse and neglect cause many psychological problems not just in their childhood but also when they turn adults. Children develop problems at school because of the lack of concentration, low self-esteem, depression, anxiety, trouble sleeping and turn aggressively. As adults, they experiment problems in relationships, mental health problems, and resentment or anger which sometimes makes them abuse other children.

The rights of children are being undermined by American civic laws. Children see a comfortable amount of protection from the government, but several issues exist as a result of America still not ratifying The Convention on the Rights of the Child, meaning children are not being protected from abuse, malnutrition, and are not receiving basic health needs. one in four children in America go hungry every day because of lack of food. This percentage of children are primarily of different ethnicity. A child must never go hungry no matter what ethnicity they are, America must protect their younger citizens (0-18 years of age) from going hungry. Abuse is something several children fear everyday with three million cases being reported, 10% being sexual abuse, and about 1000
It is found that from the years 2009 to 2013, a documented 63,000 children were reported as victims of sexual abuse or harassment. Statistically, it is also found that every eight minutes, Child Protective Services find evidence or claims of child sex abuse. The effects of this abuse can be long-lasting and consequently affects the mental health of a victim. It is found that victims who encounter sexual harassment are four times as likely to develop drug abusiveness, post traumatic stress disorders, and three times as likely to develop anxiety or depressive episodes (Children and Teens: Statistics). The consequences of sexual abuse are not only found to be confined to the times of incidents but develop lasting effects on the victims long after the incident occurs.
