Introduction

Human wants are insatiable in nature! The insatiability nature of man, influences man’s behavior differently under different circumstances; and in particular, the socialization process of different people explain their behavior and perception of the world around them. Due to the differences in individual socialization processes, man turn to exhibit differences of opinion over issues with their neighbors even as man lives in a global society. Differences may arise in the family settings, between husband and wife, parent and children; at the work-place, between employer and employees, employees against employee; between Teachers and Students between one States and another State.

However, some may want to employ another method of resolving the problem for some obvious reasons. It may be to reduce time spent in court; cut down financial cost or to maintain a good relation after the issue has been resolved. In this instance the disputants may wish to involve a neutral third party (Mediator) who is respected by both parties to the dispute to supervise the resolution of the problem. The mediator may be an individual in his own right or a corporate personality like the UN, the AU or any such identified body (especially in the case of mediation between disputing states) to assist in resolving the dispute . One of the processes of settling the dispute outside the court room is called the Mediation.
Richard C. Crock pointed out that the dispute resolution service provided by Commission on Human Rights and Administrative Justice (CHRAJ) “is based on the use of a modern and internationally accepted form of Alternative Dispute Resolution (ADR) which focuses on mediation and the construction of mutually accepted agreements between individual disputing parties”

Both facts and feelings are considered with the help of an impartial mediator. Mediation is private and confidential. The mediator and parties must maintain as required by law, the confidentiality of the information disclosed during mediation. Mediation is voluntary, and may be terminated at any time by a party or the mediator.
