It’s a true fact that people kill people, not guns. However, people use guns to kill people. So then, it would be understandable to think that it is necessary to control who can get guns. But yet, a large number of guns are sold to people whose backgrounds aren’t checked. This means America isn’t completely controlling who all can get guns — nobody is. While universal background checks seem like common sense, gun lobbyists say that criminals could just get their guns from the black market so there is no point controlling all gun sales (Sullum). To begin, there are some federal laws that are constant in every state but, states are allowed to make their own laws. One of these federal laws is the Brady Act. The Act requires all licensed gun sellers to run a background check on their buyers and they also have to record the sale. While the federal law only requires this on licensed sales, some states have implemented universal background checks. A universal background check requires a background check on all gun sales, not just licensed ones. Some of these states include: California, Colorado, Connecticut, Delaware, and 8 more. Another federal law is that a person must be 21 to purchase a handgun and must be 18 to purchase a rifle or shotgun. Something else that isn’t necessary a law per say but is instead a loophole. This would be what is known as the “Gun Show loophole.” Contrary to its name, it is not only a gun show loophole, but more of a private sale loophole. This act required a five day waiting period for sales of handguns to unlicensed persons. During this five day period, state and local law-enforcement are required to check the background of the individual before the sale can go through. This went into effect on February 28, 1994. After being struck down in 1997 by the Supreme Court, the FBI created the NICS or National Instant Criminal Background Check System. While the 5 day period part of the act only applied to handguns, the new NICS part applies to all firearm sales. The NICS works in a way that if you have a clean background, your sale could go through quickly whereas if something pops up in the NICS, will sort of work how the original act worked. This would encourage firearms dealers to only sell weapons so individuals they do not believe will commit a crime. In the state of Florida, and many other states mental health checks are not required when purchasing a firearm ("Possession of Firearms by People with Mental Illness"). Regardless of their mental state, if the dealer themselves choose to sell an obviously mentally ill person a firearm, they can. In many states, they do not require any live fire training before firing a firearm (Mascia, Jennifer). This bill would add more people to the criminal background check database, which would stop poeple on the list from buying a gun. It would also make it so every gun purchase would require a background check. This would close the gun show loophole, where you can buy a gun at a gun show without a background check, but need a background check to buy a gun at a store. Proponents want this to pass to keep criminals from getting guns more easily. It is too easy for a criminal to buy a gun at a gun show, at some criminals are not on the list of those with criminal backgrounds that should keep them from buying a gun at store.
There are laws to protect and make it legal by obtaining a license in the state in which an individuals is purchasing a gun but that do not stop the black market. Gun control laws and violence with in different states is a clear view that the gun control laws/bans are not really helpful in today’s society. I feel that the law did not abolish the black market of gun purchases therefore people are still purchasing guns illegally for what the state ban in the first place. Which is why criminals are still able to purchase guns, since they know of places where background checks are not required. This affects how people get gun drastically. If they are not able to go to the store anymore because background checks came up were not acceptable not allowing that person to purchase a firearm. Statics brought to attention by gun control opponents, show that gun control laws have done little to reduce crime rates. Several restrictions have been made on certain guns, considered as overly dangerous, though in the hands of an unstable criminal even a legal hunting gun can be deadly. Countless restrictions have been made, however people have still found ways around them. If people are unstable and determined enough, they will find a gun, regardless of the restrictions or regulations.
In today’s society, one of the most alienating issues in American politics is gun control. More specifically, the issue is whether or not guns should be banned in the United States. Some people would say that guns should be banned because it would reduce crime as a whole and keep citizens safer. These people, enthusiasts of stricter gun laws, fear being safe in their country where there are so many people who have access to guns. Opponents of this argument, however, also fear losing safety.

What these gaps in gun control mean is that purchasers of firearms who commit violent crimes have probably done so legally. Each year more guns are produced and purchased and more individuals go unchecked as they arm themselves for that point in the future where they will decide to use their destructive arms. It is estimated that over 300 million firearms are in possession of private US citizens, that is roughly one firearm per American (Horsley, 2016). Everyone here would probably be thinking that guns are more difficult to purchase then cars right? In fact, it’s the exact opposite. To get a car, you must first get a license, get car insurance, buy the actual car, get all the paperwork done, and finally register the car. Without including the training to get a license, this procedure can take over a month. However, to purchase a gun you need to go over to the nearest Walmart, answer some questions, and wait a couple of minutes to let the gun dealer make sure you haven’t committed any felonies and Voila!
