As what we’ve mentioned before in the PESTLE, there are a total of 20 women or girls being raped in Indonesia every day. With the amount of rape victim that continuously increasing every year and the report of the affect experienced by the victim after the incident that the government had received, Indonesian government consider of establishing a regulation to protect the rights and dignity of the rape victim especially for those who are pregnant because of it. Moreover, with the consideration of psychological trauma that can affect the pregnancy, the social treatment they got, the victim’s age that still underage, and the condition of the victims that are not ready to have a baby yet both financially and mentally, add more reasons to establish the regulation. Therefore, the government established a regulation that exclude the application of prohibition of abortion in Indonesia which is Constitution No. 36 Year 2009 …show more content…

Police department has set the regulation and the consequences for those who claim to be a rape victim but actually not one. As what have been mentioned in the Presidential decree, the victim must be provided with confirmation letter from psychologist and permission letter from police department to be able to perform abortion. If the women are not a victim, she can be charged for giving false information, adultery, and fraud and so on according to Criminal Code.
So, abortion right for rape victim has successfully influence the government to change and create another government regulation to be able to support the Constitution No. 36 Year 2009 concerning Health especially in Abortion section. The government also have to consider other regulation such as Constitution No. 23 Year 2002 concerning Child Protection, to be able to implement the abortion right for rape victim without causing uproar in the
