FACTS Thomas Lubanga Dyilo was born on 29 December 1960 in Jiba, the Democratic Republic of the Congo (AMICC 2006). An educated man, with a degree in psychology from the University of Kisangani, and married with seven children. Lubanga Dyilo was broadly known for forming and leading the political and paramilitary group: the Union of Congolese Patriots in 2001. Under Lubanga Dyilo’s control, the Union of Congolese Patriots became one of the leading participants in conflict within ethnic groups. This brought him to form the military wing of his union: the Patriotic Force for the Liberation of Congo. The Ituri region, which was rich with natural resources, became a battlefield; consequently, this led to thousands of innocent civilians being massacred. Powerful supporters of Lubanga Dyilo were instructed to kidnap children from their homes. With influence over the radio station ‘Okapi’, Lubanga Dyilo ordered to have each family whom were living within the districts of his power to donate a cow, a sum of money or a child to increase war efforts. Due to the poverty levels within the communities, families did not have the financial stability donate money or cows. This caused many children between the age of eight and fifteen to be sent to join the Patriotic Force for the Liberation of Congo; therefore, surrendering their lives to follow through with his orders and become rebel soldiers, carry weapons, and execute horrendous crimes. Whilst under his command, the Union of Congolese Patriots military wing was responsible for many atrocities: such as mass murder, and torture towards the ethnic group, Lendu (The Prosecutor v. Thomas Lubanga Dyilo). In the world today, there is more than 25 countries who still actively use children in warfare. Child soldiers are human beings under the age of 18 who participate in military actions. They are evidently cheaper to maintain and to train than adult soldiers. They are also more loyal and obedient because the young respect their elders. It has been noted that estimately, 300 thousand children were recruited to fight and perform in war (Child Soldiers.)
In the end, when the conflict has cooled, the question rises, who was to blame for all the death? Most obviously were the leaders of each army and/or the source of the disturbance of peace, but can you blame an ex-child-soldier for their atrocities? People can’t simply accuse a former child soldier for crimes that they suffered a “childhood” where there was no other choice. There are probably many variables that went into making a child into a killer as proven in the article, a former child soldier will stand trial in The Hague for war crimes, “Clearly, the traumatized psychology of the child soldier will be part of Ongwen's defense when his trial begins at the ICC” (3), as this quote demonstrates how very little children probably ever joined the army willfully without trauma or fear for one’s self or someone close to them. In the article, “CHILD SOLDIERS AND THE GLOBAL AGENDA” it says, “Children need be the victims of war only if there is no will to prevent it.” This helps show how children should not be involved in war in the first place. They aren’t the ones who have started the war. It isn’t their fault in the first place so why are people punishing the children for their involvement when it wasn’t their fault. They expect the kids to serve time or to get a death sentence when it was adults like them who brought them into this mess.
