FACTS Thomas Lubanga Dyilo was born on 29 December 1960 in Jiba, the Democratic Republic of the Congo (AMICC 2006). An educated man, with a degree in psychology from the University of Kisangani, and married with seven children. Lubanga Dyilo was broadly known for forming and leading the political and paramilitary group: the Union of Congolese Patriots in 2001. Under Lubanga Dyilo’s control, the Union of Congolese Patriots became one of the leading participants in conflict within ethnic groups. This brought him to form the military wing of his union: the Patriotic Force for the Liberation of Congo. The Ituri region, which was rich with natural resources, became a battlefield; consequently, this led to thousands of innocent civilians being massacred. Powerful supporters of Lubanga Dyilo were instructed to kidnap children from their homes. With influence over the radio station ‘Okapi’, Lubanga Dyilo ordered to have each family whom were living within the districts of his power to donate a cow, a sum of money or a child to increase war efforts. Due to the poverty levels within the communities, families did not have the financial stability donate money or cows. This caused many children between the age of eight and fifteen to be sent to join the Patriotic Force for the Liberation of Congo; therefore, surrendering their lives to follow through with his orders and become rebel soldiers, carry weapons, and execute horrendous crimes. Whilst under his command, the Union of Congolese Patriots military wing was responsible for many atrocities: such as mass murder, and torture towards the ethnic group, Lendu (The Prosecutor v. Thomas Lubanga Dyilo). Recruiting child soldiers goes against the Rome Statute in accordance with article 8 (2)(b) (xxvi); hence, resulting in the case being brought to the International Criminal Court (Rome Statute of the International Criminal
