I observed the CAD showed Officer Schultz at the Muckleshoot Casino on an auto recovery. It was later discovered Officer Schultz was in the west parking lot of the Bingo Hall. When I arrived I observed Officer Schultz had two males detained at the front of his patrol vehicle and he was holding a handgun in his right hand. One male was sitting on the push bar of the patrol vehicle and Officer Shultz was holding onto the other male. It appeared to me Officer Schultz had located the firearm while he was searching the male, who was later identified as Alexis Hernandez. I took the firearm from Officer

The only information the officers were given was shots fired but, Deputy Murphy’s comment “if I have to go in there myself I’ll charge him with anything I can find” Is over the top and unnecessary. He didn’t know what the situation was I think the officers were right to enter his house to make sure anybody in the house is ok. Since the only information they had was shots fired the officers messed up when he took the mans keys to get into his gun safe that’s when his 4th amendment rights were violated.

At approx 1:15 pm ON 8-29-16, I was sitting at my desk in my office with the door closed. I heard the raised voice of someone I didn 't recognize yelling repeatedly, "get your hands off me" and similar variations of the demand. I did not hear any other voices. I then opened the door and left my office to find Ofc Jaques searching a male black subject who was now found to be the source of the yelling. Ofc Jaques could be heard sternly but calmly giving orders for the subject to comply with his orders in order to be searched prior to being held in the nearby cell.
Due to the police “brotherhood” they took the situation lightly and turned it into a mess. No proper questioning or evidence was collected due this facet. A major factor was that Officer Banks was treated has if he was innocent a hundred and ten percent. The sheriff’s department should have questioned him and detained him like any other case.
Just the Facts If an officer learns after the fact that what he perceived to be a weapon was actually a toy gun, a cell phone, or even a wallet, the standard by which the action will be judged will come from what the officer knew at the time. Officers need not, and often times cannot afford to, wait for a subject to pull the trigger or try to stab them before they react. Instead, they must weigh the totality of the circumstances and make a decision based on the facts available to them at the moment. Reasonable Choices The objective reasonableness standard establishes that officers are not just limited to the least amount of force possible.
