A Burning World Tod Willingham was convicted of arson Dec 23rd 1991 in Corsicana, Texas. There were many signs that he could have done it, but there were more signs that prove his innocence. Arson wasn’t the only thing he was convicted for, he was convicted for the murder of his 3 daughters as well. In this essay, the evidence will show that Tod Willingham was innocent and didn’t deserve the death penalty or even prison. The first bit of evidence that convicted Tod Willingham of arson was the fire allegations. They were unjustified and used outdated information to prosecute Tod. A study was done by professional arsonist John Letini and Dr. Hurst showing how the fire department’s report was false. “That in and of itself is enough to toss a case out for arson.”-John Letini. The arsonists have studied the different ways a house can catch on fire and have concluded that the house fire was a flashover and not a case of arson. Generally, people who study topics for years have a better understanding than the people doing it. Due to the main allegation being the report made by the fire department, this evidence rebutling the fire department should have by more than enough evidence to throw this case …show more content…
Johnny Webb was Tod’s jailmate and told the jury that Tod confessed to his crimes. This evidence was very shady because of his statement,”I don’t remember, you know what I’m saying. Something to put pressure on somebody to do something to get me out.” Johnny was a notorious liar and other evidence was found that after he gave his testimony, his sentence was shortened. Almost always, a prisoner will do anything to get their sentence shortened. Why would a man known for lying not lie in court just to get his sentence shortened. Another one of the main allegations based on lies, how would they allow this to happen? How was this case even formed if all of the evidence
Litigant Henry Xavier Kennedy claims the liable decision in a jury trial for the wrongdoing of first degree fire related crime in the September 23, 1981 flame which leveled his log lodge. He guarantees that the jury charges, or now and again called directions to the jury by the judge, were mistaken in a few distinct ways and that there was insufficient proof to convict him of the charge. Kennedy 's building business was moderate, and he had two home loans on the lodge which was the building being referred to. He had restored a protection approach on the building for $40,000 days prior. Kennedy had told agents that he had a strong plausible excuse from 12:00 midnight until 4:00 a.m. which would dispose of him from any wrongdoing since he was
There was no fire safety rules implied and forced and also there was doors that opened inwards so when they were all crammed in a small space trying to escape they couldn't open the door because there was to many people in the way of the door. There was one stairway they had but it lead down into a fenced in yard and the door to the yard was wooden so it would feed the fire even more. Those are some reasons why he could be responsible for the factory fire like the inadequate safety laws, but in contrast, the fire department could be also. The fire department didn't get there fast enough and they're ladders were too short.
Herbert Landry was convicted of first-degree aggravated arson on August 16th, 2006 in Provo, Utah. Based on people who testified against him as well as the dog handler, Landry was initially found guilty of aggravated arson. Prior to conviction, Landry had been displaced from his home in New Orleans from Hurricane Katrina. Since the hurricane, Landry then moved to Shadow Woods Apartment complex; where the fire was taken place. Landry sent his family to Texas while he lived in Utah.
Your Honor and Ladies and Gentlemen of the jury, in this case, we are here to prove that one night in the park Johnny Cade a violent, dirty, angry greaser pulled out his knife- the knife he had been carrying around waiting to get revenge on Bob Sheldon- and murdered him. Bob, Randy, and David stopped to take a stroll in the park where Ponyboy Curtis and Johnny Cade were waiting to attack. This is something Dallas Winston, a multiple-time offender, would do, Johnny looked up to Dallas. Therefore, we will be looking to convict Johnny Cade of first-degree murder. First of all, Johnny wanted revenge; he knew it was Bob Sheldon who had beaten him in the lot, and left a scar all the way down one side of his face, Johnny would always carry that scar with him.
The arson investigator who belived this was General Hurst and he stated that, “ Flashovers had left natural patterns on the floor that all post flashover fires tend to leave behind, and they had been misidentified as pour patterns. And thus the fire was labeled as arson.” Hurst was one of the only people who believed the fire was not arson. Hurst had the new knowledge of how arson worked and how to properly detect arson unlike the first investigators. Generally those who investigated arson were just firefighters with little to no training.
Five percent of U.S citizens have been wrongfully convicted. The book “Monster” written by Walter Dean Myers is about Steve who is on trail for a murder that he didn’t commit. There is agreeance with the jury that Steve isn’t guilty because there is a lack of evidence of his involvement and it is inferred that Steve doesn’t have a criminal record. To begin with, there was a lack of evidence of Steve’s involvement. The author wrote “one of the men arguing she points to King”(Myers 114).
The then bushfire resulted in 173 deaths as well as destroying over 2,000 residential homes. A large number of the bushfire survivors decided to take action and sue the Singapore-owned power company, claiming that their faulty equipment was the root cause of the incident. A number of days after the initial fire the Victorian bushfire royal commission discovered that the cause of the fire was a faulty power line that had caught fire. In which was owned, operated and maintained by the company SP AusNet. The power line had a failure and snapped sometime during the night, it then ignited nearby vegetation.
David Lee Gavitt’s life forever changed on March 9, 1985 when his wife and two young daughters died in a house fire. And in February of 1986 he was convicted of their murders and arson. All due to arson myths. John Fatchett a Detective Sergeant with the Michigan State Police Fire Marshal testified that there were indicators such as pour patterns (two gallons of gasoline dumped on the floor. And the fire was too hot and burned too fast be accidental.
State Statue Analysis 1. Statute: The State Statute under section §321.5 reads “any individual who maliciously and willfully burns the dwelling home of another person is punished by a period of incarceration, which does not exceed five years in imprisonment and/or a fine not exceeding $5,000 (Goodrich, 2003, p. 94). 2. Facts: It is evident that the police are asked to come Harry’s property to ascertain if it is a case of trespass. As the police arrive at the scene, the house of Harry’s is being consumed by fire, and Ann is seen on the property carrying a can containing gasoline.
Cameron Todd Willingham is not guilty of arson and therefore not responsible for the deaths of his three daughters. Todd is not guilty of arson and the death of his 3 daughters. In the documentary, experts say there is no proof of arson. Since it wasn't clear how the fire started, an arson expert came to investigate and said that there
Justin and Adnan, both in jail, and both are serving a sentence for a crime that the link is a witness who's trying to get a lesser punishment by testifying they were in it either by word or actually helping. The jury's first judgement, guilty. But now, 10 years later, they rethink whether they are guilty or innocent and if he is innocent. Did they ruin an innocent man's life? Justin Wolfe was "convicted of murder and sentenced to death."
The city also didn’t have fire alarms in almost every building, just the ones that could afford it. Even some schools didn’t have a fire alarm. The fire could have been able to be prevented by using other materials. Some buildings that weren't made out of wood, still caught fire.
This supports why Johnny is innocent because the Socs beat up Johnny very badly in the past to the point where it traumatized him so badly that he brought a pocket knife with him. Johnny also was treated very poorly in his family. The book describes Johnny as a “lost puppy”. His family physically and verbally abused Johnny and his parents don't show any emotion or affection towards him. Johnny would be innocent because of his trauma from his family and the Socs beating him up so
The more they talked about the testimonies, the more they realized that things didn't add up. At the start of the play, almost everyone except Eight voted the boy guilty. If Eight had not said to talk about it, the boy would have been sent off to die for a crime he didn't commit. The only reason the jurors changed their votes in the first place is that they felt like something was off with the testimonies. The men talking amongst themselves also influenced their vote change.
Brandon L. Garrett used a lot of evidence to support his claims in Convicting The Innocent. Garrett used many facts to support the claims he made and represented his findings with many charts, graphs, and percentages. He reviewed police reports, interrogation transcripts and recordings, prosecution files, trial transcripts, and court opinions. Just like Garrett 's Convicting the Innocent, William Stuntz 's, The Collapse of American Criminal Justice, he talks about how prosecutors now decide whom to punish and how severely they will be punished. Garrett wrote about this in his book about how the judge and jury believed the prosecutors even though before the trial they recalled a different image of their attacker then the image they have of them during
