Kramer vs. Kramer Legal Analysis Brief – Aakriti Gera
The film Kramer vs. Kramer is directed by Robert Benton and is based on the novel by Avery Corman. This film is dubbed as a classic due to play of normal life complications. The story follows the life of a couple, which is going through a divorce and through this we see the impact of their decision especially on their child.
To begin with, this film portrays a very ordinary and normal family who are dealing with everyday problems. Ted Kramer is a workaholic; his work comes before his family in order of importance. The wife and mother, Joanna Kramer is a housewife who on the other hand is dedicated to her family completely. She is depressed in her life and seeks the option of a divorce.

These traditional roles have created a stronger stereotype, which exist until date. In a lot of places it is still of the opinion that the woman should be a homemaker and a mother, and the man should be earning the money to support the family. Such outdated notions reflect in certain judgments, in particular the one delivered in Kramer v Kramer.
The reason why I was not particularly happy about the verdict was because of the nature of the mother itself. In my viewing all, I saw was someone who was in a bad state of mind and needed to break free. Her argument that the child is her son and he needs her just made me feel that she just wanted a right and not much beyond it.
The role of the mother starts to become extremely clichéd towards the trial. I believe that the father should have been awarded the custody of the child, as it should be noticed that the mother had previously abandoned her child in order to “find” herself. The light in which the father is portrayed in seems negative but actually is not. He works longer hours because of his personal issues but he deeply cares about his child and has never purposely abandoned him, he could have changed his work schedule to accommodate the new changes in his life but he is not given a chance to even try. Casey Anthony blew the news up about the killing of her daughter, the case lasted for about three years before the court finally reached a non- guilty verdict. The media and people all around America continued to speculate on reasons why they thought the verdict should have been guilty. After examining the case, two theories connect to the case. Casey Anthony has allowed me to further explore and examine all the theories so that I could explain the reasoning behind Anthony’s actions.
In the end, I believe we failed to see the real goal behind this case, which was demonstrated by the ruling. Closing Statement: Ladies and Gentlemen of the jury, here we have Ms. Abigail, an intelligent, self-sustained woman. She is now looking to whole-heartly love her twins, considering she is legally their mother from a legally binding contract between Ms. Abigail and the defendant, which was attested legal by Professor Darrow. Both parties were aware of this arrangement when the contract was signed, and in fact, happy about it, as stated by Miss Eggbert. Ms. Bertha agreed to the paid sum of $30,000 upfront and an additional $3,000 a month while she was pregnant and the 6 months following the birth of the twins, as well as all the hospital fees.
Her defense stated that her kid drowned, her father knew and was covering it up, and that her father had been touching her since she was a child. Casey was all over the place and it was clear as day that she responsible for the death of her child. With all the evidence the prosecution had to go off they in my mind didn’t have enough evidence to support their claims. In this case the police report wasn’t bad or not well written it was just that Casey’s telling to the police were lies. Each side present their cases and evidence and in the end it came to the jury to make the final decision.
There is a particular order that a criminal court case must follow and if that particular order is not followed then the court case will be deemed unconstitutional. Before a criminal court case can take place, a crime must have been allegedly committed and it is the job of the police to investigate the alleged crime by questioning anyone who may have information about the crime and also by gathering physical evidence. A person must be arrested either on the spot or the officer must have probable cause to believe a crime was committed by a particular person. The prosecuting attorney has to determine if the crime was committed by a particular person or not by reviewing all reports and records, witness statements, and the suspect’s prior criminal
The trial of Casey Anthony was one that struck the nation in a very emotional manner. The trial was on TV for months before anyone could come out with any real answers, and even then, they weren’t the answers they were looking for, and half of them were made up. In the end the jury decided to find her not guilty, while everyone else’s opinion was that she was a cold blooded killer. Unfortunately the proper evidence just wasn’t there in the end to convict her for the first degree murder of her 2 year old daughter Caylee. This being said, if I was on the jury I would definitely have found her guilty because of the, in my opinion, extremely odd behavior that came from Casey during the entire process.
Since the very beginning Casey has not been thrilled of her pregnancy, and with “ Caylee now dead, this has allowed Casey to live a good life, at least for those first 31 days” (Florida V. Casey). Through out the trial this mother was only thinking about herself, according to Attorney Linda Drone from CNN ” No one else benefited from the death of Caylee Marie Anthony”. The jury verdict was upsetting to society because of the mother not being charged with the murder or disappearance of Caylee. The Jury like what was said before only could make a decision on what was being given. There was little to no evidence that was brought to court that was investigated thoroughly to build a case or to charge her with it.
Not calling 911 and hiding the body was morally and criminally wrong. The lack of remorse bothered me as an utter disregard for her dead daughter and selfishness unparalleled. I believe that the prosecution’s putting the death

In the article, “Why Women Still Can’t Have It All,” the author Anne-Marie Slaughter is explaining how tough it is to balance family and career together. You have to take out time for your kids or else they will drift away from you, but you also have your job to handle or else you will lose that. Women have not yet received the fairness with men in workforce. I believe that it is tough for a women to handle her family and career together, and men get recognized more than women in the workforce.

In the movie Parenthood (1989), Gil says his a shitty father because his son ,Kevin, is in therapy, his daughter, Taylor, was caught kissing all the boys in school and his lastborn, Justin, keeps ramming things with his head. He blames himself because he believes that his lack of presence and choice of parenting style is the reason why his kids are having problems. Even though Gil had worked at his job for so many years and hoped to have less hours in order to spend more time with his family, he still put in the extra effort in order to get the partnership at his job. In the movie Parenthood (1989), Gil’s career suffered a setback when he was passed over for a partnership which was given to a less experienced employee that brought in multimillion-dollar clients.
There are many traditional gender roles that are a part of American society. For example, boys are supposed to like color blue and girls are supposed to like the color pink. Illustration of this gender role can easily be seen when new parents through baby showers and decorated their child's nursery, often incorporating one of the two color. Likewise, little boys are supposed to play with trunks and fake guns and little girls with Barbies and baby dolls. In addition, men are seen as the "breadwinners" or person who financially provides for the family while women are seen as the homemaking, taking care of the children and all house duties.
Although gender roles have changed over time, where males and females have become more equivalent , a certain level of behaviors and tasks which are acceptable for men and women still exist today. Alternatively of women and men steadily playing the gender roles they always play, they should change it around and try to do something divergent when being defined in a category of gender roles. However, women are becoming equal to men in our generation. For instance , would be men can take supervision of the children when the women go to work. Women are more maverick that they don’t need to depend on a man.
These were the accustomed gender roles acknowledged back then; nevertheless, various cultures could still contain them, although other don’t any longer. The culture I grew up in, still have these traditional gender roles to several degree, however several of them have distorted above a point in time; for instance, some ladies can assist men in helping with some of the households, therefore men can help them in the house caring. In many societies and depending on their cultures, men and women are seen equally and may share the same roles in the household or even a stay at home father and the mother being the breadwinner. In modern family, Phil and Claire share the responsibilities with both working and both looking after the kids. The gay couple, Mitchell and Cameron who has an adopted daughter, together they learn what roles they should take on but not being gender specific when raising their daughter and the dynamics in the household. In many families today, dual earning families increased and not just the male who goes to work but females as well and follow their dreams like furthering their careers. “In the 21st century within households two pay-checks have become essential for most families to maintain even a modest standard of living in order to provide” (Walsh, 2012:11).
