The First Amendment to the United States Constitution states “Congress shall make no law…abridging the freedom of speech”. Some people in today’s time would argue the first amendment is one of the most important listed in the Bill of Rights. Many forms of speech are protected by the first amendment that one wouldn’t think would be such as flag burning and “adult videos”. Over the years there have been many different court cases that have debated and fought the forms of speech that are protected. Many people in society treat speech differently and this is given in the United States because there are such diverse groups throughout the nation. So how should society treat the forms of speech they do not like while still protection First Amendment

Why is the first amendment the most important, people may ask? It is important because it gives people the freedom of religion, the freedom of speech, and the right to peacefully assemble and petition the government. There is a boiling pot in the America so everybody is different , and with different mixes from different places. People may say what they want because of their opinion. If they feel like they need to say their words louder than others they can do that to, well now i’m going to explain to how the first amendment is the most important .
The 1st amendment is fundamental in a democracy, it gives each individual their opinion about a certain subject and gives the people the "power" to speak out when they find something wrong. For example, they can speak what they find wrong with our Representatives, without the retaliation or censorship of the government. You might think that you can go down the street and say whatever you like without anybody telling you can't. Hold your horse right there be aware that you can say what you want but there is certain things that the 1st amendment doesn't cover. The Supreme Court has some cases where it decided where the 1st amendment was appropriate and where it wasn't.
The first amendment states that “Congress cannot enact laws limiting ”the freedom of speech or press.”’ (Kentucky Resolutions) Again, in short, this amendment is saying that the federal government is not able to pass a law that takes away someone’s right to speak their opinion. Contrary to this amendment, the Federal government did exactly the opposite of what the amendment said was allowed. The acts, passed by John Adams, take away the human right of speaking what is on the mind and using what they say to show them off as a threat.
The first amendment was limited with the Smith Act. The Smith Act prohibited the talk of violent overthrow of the United States government (Document D). This called to question whether the first amendment allowed for radical political speech the Supreme Court at the time ruled the law was justified though now a days it is considered a clear violation of freedom of speech. Later things worsened and people began to “ignore some of the basic principles of Americanism—the right to criticize; the
In 1789, thirty-eight men who helped shape America into what it is now signed the Constitution of The United States of America, approving it’s message and the rights, or Amendments, listed within it. The first Amendment listed in the Constitution is the right of freedom of speech, the press, to peaceably assemble, and religion. However, in current times, citizens are challenging this Amendment by censoring the media, books, T.V shows, and movies. Why is it that people are doing this now, after nearly 230 years? Some people believe that certain information and ideas must be withheld from certain minorities and age groups, and few others believe that some ideas must be censored to everybody.
The first amendment main purpose is to limit the power of the congress. It restricts them. The same limit however does not apply to us. We are allowed to express yourself without interference or constraint by the government but the government can limit both the content of speech and the ability to engage in speech as long as the government has a “substantial justification.”
The Importance of the 1st Amendment In 1787 our founding fathers assembled the constitution of the United States of America. Of this which contains the most important document to the American citizen, the Bill of rights. The first Amendment states: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances” These freedoms granted by the Bill of Rights are often known as freedom of expression. These rights are most important to a truly free society. The first amendment provides us with new ideas and dismisses the fear of punishment
I would give them the 1st amendment because they can say anything they want without being killed or punished. Also they can have meetings about what they want to do like for example get rid of the “Great Leader”. They can do petitions like for example “equality for women” so they can have fair rights. It would be good for them to talk to the government and see what they can decide or negotiate. If they had freedom of religion they can praise to who every they want which is fair and they won’t be forced to believe in someone but
Chapter 4 of the book We the People talks about Civil Liberties, this chapter mainly talks about the Rights that were placed in the Constitution (not in the Bill of Rights), it also talks about the Bill of Rights and it describes the rights protected by the Bill of Rights. It also talks about specific rights that work close together with the Bill of Rights and Amendments rights. One of the first Amendments that is described in great detail is Freedom of Speech and Religion. The first Amendment protects US citizens right to talk about almost any topic in the United States. I said almost any topic because there are some forms of speech that aren’t protected by the First Amendment (these forms of speech can be limited or prohibited), some of the forms of speech that aren’t protected by the First Amendment are Fighting Words and Hate Speech, Student Speech, Libel and Slander speech.
Introduction The People v. Larry Flynt ‘The People v. This newsletter evolves into Hustler Magazine, which over time gains a widespread distribution after acquiring and publishing nude photos of Jackie Kennedy Onassis, former First Lady. Flynt is sued for pandering obscenity and engaging in organised crime.
Even though the Westboro Baptist Church offends many people with their picketing and other demonstrations, I believe that the first amendment to the U.S. Constitution should continue to protect their right of performing these acts for two reasons. One, the first amendment already protects, in a sense, some of the actions the church performs, for example, the picketing of high school graduations and claiming perverts ran the schools. As unbelievable as it may sound, the first amendment allows them to say particular things like this because of what is known as the Sullivan Rule, which is a court guideline protecting inaccurate and harmful declarations against public officials as long as the claims were not known to be false at the time they
The First Amendment states, “Congress shall make no law abridging the freedom of speech.” Freedom of Speech helps those who need help and can ask the public without worry of getting in trouble. This amendment was included in the Constitution because now people e the right to advertise their work to others and have protests to things that they believe is right for the country. The amendments were important to the framers of the Constitution. The Freedom of Speech was important to the framers because of, “its diffusion of liberal sentiments on the administration of Governments.”
The first amendment may seem like something that is generally understood among all of those who use it, but this may not be the case. While most citizens of the United States of America would certainly say that they understand and can comprehend what the first amendment means, an underlying lack of knowledge, upon what is presumed to be the most important of all the amendments, can still be discovered. “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press, or the right of the people to peaceably assemble, and to petition the Government for a redress of grievances.” The specific piece of the first amendment that is particularly important
We all have heard of the Bill of Rights because they outline what we as American citizens are entitled to and what the government can’t control. The Constitution lays out the building blocks of the United States of America and the first ten amendments are what are known as the Bill of Rights. Having the Bill of Rights in our Constitution plays a big role on how government power is distributed. Our Founders wanted us to have as much freedom as possible without causing chaos. Instead of having all power and freedom rely on one government, we decided to break it down.
The first amendment is very important for United State citizens. Freedom of speech is one of the most important rights. Freedom of speech grants us rights to say what we want without getting in trouble with the law. This law is important because it allows us to express our opinions. Freedom of religion is another right that is very important.
