1. A pretext stop occurs when a police officer stops a driver for a minor traffic violation so that they can later investigate a different suspected criminal offense. In Robinson the pretext for the stop was that a car sped through a red light. The true reason for the stop was to make sure that no robberies happened that night and to arrest the defendant if there was evidence that he might commit a robbery.
2. In Whren v. United States, the U.S. Supreme Court held that as long as the officers have reasonable cause to stop a vehicle than any search and seizure of illegal items in the vehicle
The Impact that Race and Class has on Wealth America is a place of potential opportunity and success. There is a possibility of prosperity for everyone, no matter one’s race, social class, or ethnicity. However, success is more easily achievable for white Americans. People of color in America have struggled for centuries with housing, jobs and education all due to their race. Even though it is not just, white Americans have had the upper hand simply because of their skin color.
Procedural History: At the suppression hearing, Hayes said he asked Macabeo basic questions that he would normally ask on a stop. He thought the defendant was acting fidgety so he conducted a patdown which did not reveal anything suspicious. He removed his cell phone out of his pocket and handed it to Officer Raymond. Raymond searched the phone without consent from the defendant.
CASE CITATION: Maryland v. Pringle, 540 U.S. 366 (2003) PARTIES: State of Maryland, Petitioner / Appellant Joseph Jermaine Pringle, Defendant / Appellee FACTS: On August 7, 1999, at 3:16 am, a Baltimore County Police officer conducted a legal traffic stop on a Nissan Maxima containing to Joseph Pringle for speeding. That is reasonable suspicion. The Supreme Court's decision involved the fact that the officer had nothing but a feeling that the men were up to no good, and had a reasonable doubt that they were
Police officers in the United States are given considerable amount of authority to perform their duties. New York City’s officers are given the authority to Stop, Question and Possibly Frisk (SQF) an individual based on reasonable suspicion of criminal activity. SQF is also known as the Terry Stop. This procedure is conducted when an officer has reasonable suspicion to stop and question a suspicious individual. Next, a possible frisk can be conducted if the officer has a reason to believe that the individual is carrying or conceals a weapon or other contraband.
Race-related events have been occurring for centuries. I agree that it is in reverse in our time of age. I know about Sandra Bland, the girl who was dead at the site of her picture taking. This is so wrong and destructive against black women. This was racism towards a women who was not a criminal.
Race Relations in Texas History Texas has long been regarded as The Lone Star State, and throughout its history, attracted many different cultures and ethnicities to call it home. Some migrated to the land for gold, other to escape religious persecution in European countries. From the early contact with Native Americans to the discrimination of illegal immigrants in present day, the history of Texas teems with examples of issues of races relations. Texas’ long battle with racism began with the discovery of the Mexico and Texas area in the 1500s by the Spanish. Motivated by the fabled riches and cities of gold to be found in the new world, these men, known as conquistadors, began a journey into unknown territory, and with them, brought immense
Community Action Project We all live in a society where criticism is inevitable. People are afraid to express any pride in their nationality due to the fear of being judged by everyone around them. Racial microaggressions affects one’s ability to freely express their racial backgrounds without the fear of being inaccurately represented. Individuals of different ethnics are assuming what others are like based on their appearances in the media.
The phenomenon of racial passing was frequently seen in the United States at the end of the 19th and beginning to mid years of the 20th century. The term “passing” was classically used as a paraphrased version of “passing for white,” considering that it was common for passing to involve an extremely fair skinned black person who “crossed over” or “passed” into white society. Typically, during this time period white and black attitudes about passing were negative, but for different reasons. White attitudes presumed that a light complexioned Negro who passed intended to “trick” whites as a means of challenging white supremacy by deflowering and tainting unsuspecting “pure” white women. Darker skinned blacks or “pure Negros” viewed passers as
There has been many controversial issues about the “stop-and-frisk” law. One side believes that it is racially profiling the communities of minorities and the other side believes that it is helping communities rise away from violence. There is a lot of history and background on stop-and-frisk and how it originated in the United States, especially in different places around the world. This law has been very controversial even within the law itself, so controversial states are debating on getting rid of it completely. Many politicians speak on this tactic in both positive and negative ways and the statistical growths and decreases on this topic.
Conflict theory has been used to describe the discrepancies in power and distribution of resources among the dominate group and the subordinate groups. Racial inequalities and racism among the groups has played a big role in the concept of conflict theory. Conflict theory examines the rising conflict between the dominate group, or white ruling class, and racial minorities, such as African Americans. This conflict and inequality among the races may be a reason why 20.2 percent of African American males die by homicide. In fact, African Americans are six times as likely as whites to be killed by homicide.
Solommon Yohannes October 5th, 2017 Sociology& 101 Mr. Woo Racial Inequality Viewed Through the Conflict Perspective Lens The racial inequality that we have in modern day blossomed from the historic oppression and comprehensive prejudice of minority groups. From the very beginning of “American” history, other groups of people who were not of European decent were discriminated against and treated inhumanely and without the smallest regard for their lives. Native American populations were decimated by diseases brought oversea by Europeans and forced from their ancestral lands by settlers to make room for their expanding populations.
Dr. CJ, Racial divide is much like other issues we face in a fallen world, in that it will never be eradicated. With that said, I am still optimistic that we can decrease the amount of discontent toward first responders in our communities by matching the mission statements of the organizations with their actions. Or in simple terms, make the organizations more diverse which is in many cases responding to their needs. Clackamas fire (D1) states in its values: anticipate and respond to the needs of the community(clackamasfire.com, n.d., Mission Statement). Which, I do believe D1 does well.
I felt like no one would believe me. I couldn’t tell anyone. I kept it in till now... I still am scared. Definition of stop and frisk: “Stop and frisk” is the police practice of temporarily detaining people on the street, questioning them, and possibly also frisking or searching them.
This chapter explains the difference between race and ethnicity and how they came about. It also explains the advantages and disadvantages some have due to the creation of race. Race and ethnicity have strong foundations not only within countries, but between them. Globalization has increased the individual’s ethnic identities, but has also put some at disadvantages. Having different races and ethnicities is not an issue, but ranking the different races and putting others at disadvantages creates issues.
