Status Quo
Recently developed technologies have shaped modern society in previously unprecedented ways. With the advent of the Internet, and its easy accessibility through mobile and computer technology, people’s everyday lives have been changed accordingly. One of the side effects of this technological revolution has been increasing infringements of intellectual property (IP) rights, including copyrights. Though the Internet has made it easier to detect violations of IP rights in some ways (it is easy for a copyright holder to search for violations of their copyright online), but it has also propagated IP violations through the illegal uploading and downloading of copyrighted media (usually films, television, or music) online (also called piracy). In China, due to the popularity of Korean music and television shows, a large portion of this copyrighted media that is pirated has its origins in the Korean entertainment industry.

In following with the Berne Convention, the general period of protection of copyright is the duration of the author’s lifetime and 50 years past the author’s death. In the case of photographic and cinematographic works, the copyright protection period is 50 years after the first screening or publication of the work. Works created by an organization or works created by a person in the course of employment for an organization is also 50 years after the first publication of the work. If a photographic or cinematographic work, or a work created by an organization is not published within 50 years of its creation, then copyright law does not protect the work.
